On October 12, 2022, at 10:50 a.m., Licensing Program Analyst (LPA), Cindy Hamilton met with licensee Mahsan Moosavi-Tabarshiyade (FCCH) to deliver the findings for the above stated allegation.  During the investigation, LPA Hamilton conducted interviews with three staff and three parents.  LPA Hamilton and LPA Nasha King conducted health and safety inspections of the FCCH on 07/18/2022, 08/04/2022 and 09/20/2022.  LPA obtained and reviewed pertinent documents from the facility’s staff and children’s files. LPA Hamilton was unable to interview Parent #5 (P5) due to P5 did not return LPA’s telephone calls.

On July 14, 2022, Community Care Licensing (CCL) received information stating day care children were left unattended. It was alleged that children are left unattended while in care. Confidential interviews revealed to LPA that children are left in highchairs or Pak N Plays during breakfast and lunch to warm-up food, but staff is to go back and forth to check on the children. Further interviews revealed that children may be left unattended for approximately five to ten minutes, and this was confirmed by LPA during a visit

conducted on 08/04/22 where 6 children were observed being left unattended while food was being prepared in the kitchen. In addition, during an Annual inspection visit conducted on 09/20/22 with Licensing Program Manager (LPM) Carlos Martinez, LPA and LPM observed 2 children napping in a room with a closed door and no direct line of sight.

Based on confidential interviews and observation, the preponderance of evidence has been met and the allegation that day care children were left unattended is substantiated. The FCCH is being cited for Title 22, Section 102417(a) Operation of a Family Child Care Home which poses a potential health and safety risk to children in care. This requirement was not met as evidenced by confidential interviews and observation licensee allows children to be left unattended in highchairs and Pak N Plays during mealtimes and are left behind closed doors during nap time. .

An exit interview was conducted, this report, appeal rights and Notice of Site Visit was explained and provided to licensee. Licensee was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.

LPA Hamilton was unable to interview Parent #5 (P5) due to P5 did not return LPA’s telephone calls.

On July 12, 2022, Community Care Licensing (CCL) received information stating day care home is not maintained clean and sanitary and facility is out of ratio.  Regarding the allegation that day care home is not maintained clean and sanitary, it was alleged that the FCCH has a dog on site and has dog “poop” around it. Licensee did confirm there are two dogs at FCCH and one goes to “doggy daycare” daily during business hours.

Confidential interviews resulted in LPA being provided conflicting information. Confidential interviews revealed to LPA that the FCCH had dog “poop” on the playgrounds and FCCH was barely cleaned; whereas other confidential interviews disclosed that the FCCH is cleaned daily and deep cleaned on Tuesdays and Fridays by licensee and staff. In addition, licensee has someone come in and clean the facility every other week. Other confidential interviews disclosed that the parents do not come inside the FCCH, but during initial tours, the FCCH was very clean. During visit on 09/20/2022, LPA did observe dog feces in an off-limit area of the FCCH yard and it was immediately removed by the licensee.

Regarding the allegation, facility is out of ratio, it was alleged that the FCCH had 23 children at one time with only two adults providing care and supervision. It was observed by LPAs during visits to the FCCH on 07/18/2022, 08/04/2022 and 09/20/2022 that the FCCH was operating within regulated staffing ratio and capacity as stated within Title 22. Also, FCCH records were reviewed and revealed the FCCH only has 14 children currently enrolled. Confidential interviews resulted in conflicting information being provided to LPA. Confidential interviews disclosed that facility had 23 children in attendance daily with three adults and then one quit, leaving only two adults providing care and supervision; whereas other confidential interviews disclosed that the FCCH usually has 10-14 children per day with three qualified adults present.

Based on confidential interviews, records review and observation, the allegations that day care home is not maintained clean and sanitary and facility is out of ratio, may have occurred, however are not supported or proven by evidence. Therefore, the allegations are unsubstantiated. A copy of this report, appeal rights and Notice of Site Visit were provided to licensee.

The Notice of Site Visit was posted by the licensee prior to LPA leaving the facility and the licensee was reminded this notice must be posted for 30 days.
