On the above date and time listed, Licensing Program Analyst (LPA) Keely Messerschmidt arrived at the facility for the purpose of delivering the complaint findings on the above-referenced allegations. LPA met with Director Tonya Handley.

On July 22nd, 2025, Community Care Licensing (CCL) received a complaint alleging that staff member does not accord dignity to day care child in care, staff member did not allow day care child in care to use the restroom as needed, staff member forced day care child to sleep on soiled napping equipment while in care and that staff member forced day care child to sleep with a wet towel while in care.

Regarding the allegation that staff member does not accord dignity to day care child in care, based on interviews conducted 3 out of 3 staff members stated that they have never witnessed Staff #1 (S1) make any racial remarks to Child #1 (C1) or ever treat C1 differently due to the color of their skin. LPA interviewed S1 and they stated they treat all children in their care the same way and has never made racial remarks to C1. See LIC9099-C

Pertaining to allegation staff member did not allow day care child in care to use the restroom as needed, based on interviews conducted 4 out of 4 staff members stated that the bathrooms are not located in the classroom that C1 is enrolled in. Staff also stated that during nap time if they are alone and a child requests to use the restroom, they call for assistance and ask the child to hold on until someone else comes. S1 stated they never did not allow C1 to use the restroom, but they did ask C1 to hold on while someone else came to maintain ratio.

Pertaining to allegation staff member forced day care child to sleep on soiled napping equipment while in care, based on interviews conducted 4 out of 4 staff members stated that napping equipment is not assigned to each child but is sanitized after each use. S1 stated that C1 was never given napping equipment that was soiled but recalled C1 making this statement in class but wasn't sure where it came from since everyone's equipment was already cleaned.

Lastly, pertaining to allegation that staff member forced day care child to sleep with a wet towel while in care, based on interviews conducted 4 out of 4 staff members stated that when a child forgets to bring a blanket for nap time they either use a spare blanket if available or whatever else the child has in their cubby. S1 stated that C1 did not have a blanket so they used C1's towel which is as large as a blanket but it was dry as water play occurs after nap time.

Based on the information obtained during this investigation, it has been determined that although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violations did or did not occur. Therefore, the allegations are UNSUBSTANTIATED.

An exit interview was conducted, and this report was reviewed with the Director, Tonya Handley, and a copy was provided. Appeal rights were discussed and provided during the exit interview.

A Notice of Site visit was given, and Director understands that it must remain posted for 30 days.
