Licensing Program Analyst (LPA), Keely Messerschmidt, made a subsequent unannounced complaint investigation visit to deliver findings for the above referenced allegation. LPA met with Theresa Morales, who was informed of the decision rendered.
LPA Messerschmidt is delivering the findings of the complaint investigation conducted by Investigations Branch (IB) Investigator, Thomas Smith. Per interviews conducted, and information gathered, the investigation revealed that through a forensic interview with C#1 that was conducted on 6/5/2023 by Investigator Ge Sun, Oceanside Police Detective Zachary Knox and Investigations Branch (IB) Investigator, Thomas Smith, C1 was able to demonstrate the difference between right and wrong. C1 was asked several times if anyone touched or hurt their private parts at the daycare. There was no disclosure by C1 of any inappropriate/sexual touching by anyone at the preschool. In addition, suspect denied the allegations and there is no evidence or witnesses to corroborate the allegations.

Therefore, based on the information provided during the course of investigation, it cannot be determined that Child #1 was inappropriately touched. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED, at this time.

An exit interview was conducted. A copy of this report was provided to the facility.

This report must be made available for public review for 3 years upon request.
