On Septmber 19, 2024, at 2:31PM, Licensing Program Analyst (LPA), William Chancellor arrived unannounced to Childrens Choice Academy: Vista (CCC) and met with Shannon Spencer to discuss the investigative findings of the allegation’s listed above. On July 26, 2024, at 11:15AM LPA conducted a tour, took census of the CCC and gathered evidence relevant to the investigation. During the investigation, LPA made observations and conducted confidential interviews with four staff (S1-S4).
On July 24, 2024, a complaint was received alleging that staff did not prevent daycare child from being bullied by another child. Specifically, that Child 1 (C1) is being hit by Child 2 (C2) every day. On July 19, 2024, LPA made observations of the classroom when both C1 and C2 were present and did not directly see any incidents occur involving C1 being hit by C2. However, on July 26, 2024, LPA observed C2 engage in fifteen or more incidents, where C2 was physical towards peers and adults. Involving hair pulling, hitting, grabbing toys and spitting. Each incident LPA observed were neither predictable or provoked by another person; instead, C2 was observed to independently go up to someone, engage in a behavior, expect a response, and run away. All the while, a teacher was repeatedly attempting to prevent and or redirect C2 to engage in a more appropriate activity.

Secondly, it was also alleged that staff did not provide a safe and comfortable environment for daycare child. Specifically, that C1 was being disruptive in class by moving furniture, throwing toys, and breaking a flower vase. Photos were provided to parent of C1 on top of classroom furniture, instead of removing the child or preventing C1 from destroying the class further. Observation, interview, and record reviewed confirmed that C1 previously had a Behavior Therapist (BT) when C1 was present at the CCC. In June, the BT was taken off the case by C1 parents and C1 still attended without a BT. Records reviewed also confirmed that C1 was without a BT for a full month, leading up to the incident on July 23, 2024. Based on observations and interviews, C1 currently engages in tantrums and aggressive behaviors as a method to get needs met and is not able to effectively communicate to adult’s and peers. Four of four interviews confirmed that C1 will engage in biting and hitting other peers when they have a toy C1 wants or take a toy that they were playing with. While tantrums are age appropriate for C1 age, the intensity in which C1 engages in these behaviors has resulted in C1 being removed from other daycare’s and isolated from other peers their age. The CCC did attempt to accommodate C1 needs and behaviors when BT was present, however, due to ratios and staffing, CCC staff are not equipped to continuously remove a child from a classroom.

Based on interviews and record review, LPA is unable to corroborate the allegations staff did not prevent daycare child from being bullied by another child and staff did not provide a safe and comfortable environment for daycare child. These allegations may have occurred; however, they are not supported, or proven by evidence. Therefore, the above allegations are unsubstantiated.

An exit interview was conducted, a copy of this report, appeal rights, along with a Notice of Site Visit was handed to Shannon Spencer. Notice of Site Visit must remain posted for 30 consecutive days in a prominent place, visible to families and caregivers.
