On the above date and time, Licensing Program Analyst (LPA) Kelly Gerth arrived at the facility to deliver the findings from a complaint received by Community Care Licensing (CCL) on March 26, 2026. LPA met with New Song Child Care Center (CCC) Director Jane Gomez, toured the facility, took census and provided the purpose of the visit. The allegations received stated that Staff do not ensure children are not disturbed while napping.
On 03/27/26, LPA Gerth conducted interview with Staff 1-Staff 4 (S1-S4), collected copies of evidence and reviewed files pertinent to the investigation. During the course of the investigation, LPA also conducted classroom observations both prior to and during the children’s nap period at the CCC. LPA was unable to reach the reporting party for an interview as no contact information was provided.
Regarding the Allegation Staff do not ensure children are not disturbed while napping. During the course of the investigation, interviews revealed that the CCC has experienced challenges minimizing classroom disruptions during nap time due to certain child behaviors.

On the above date and time, Licensing Program Analyst (LPA) Kelly Gerth arrived at the facility to deliver the findings from a complaint received by Community Care Licensing (CCL) on March 26, 2026. LPA met with New Song Child Care Center (CCC) Director Jane Gomez, toured the facility, took census and provided the purpose of the visit. The allegations received stated Staff did not prevent child from harming other children in care.

During the course of the investigation, LPA also conducted classroom observations both prior to and during the children’s nap period at the CCC. During the course of the investigation, LPA conducted interviews with S1-S4, conducted observations and reviewed children’s files. Interviews with staff indicated that the CCC initially lacked sufficient awareness of the needs of children displaying behavioral challenges and did not take proactive steps to identify existing behavior plans.

However, more recently, the CCC has begun gathering detailed information for children’s records. Additionally, while some staff indicated that the observed behaviors may have been preventable, other interviews reflected that staff did take measures to prevent harm to other children. During the course of the investigation, some evidence gathered did support that there had been attempts made by the CCC to prevent other children from being harmed. Therefore, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is UNSUBSTANTIATED.
An exit interview was conducted, and this report was reviewed with Director Jane Gomez. Appeal rights were discussed and provided during the exit interview. A notice of site visit was given and licensee understands this must remain posted for 30 days.

As a response, the CCC has moved C1 and other children exhibiting disruptive nap-time behaviors into neighboring classrooms to address disturbances in the original classroom. However, the CCC has not implemented additional classroom management or support plans within the receiving classroom to ensure a restful environment for all children. Therefore based on interviews conducted, observation and evidence gathered, the preponderance of evidence standard has been met and the above allegation is found to be SUBSTANTIATED.
