32 | LPA interviews with staff determined that within the current calendar year, 2025, possibly earlier, there were instances where another staff member yelled at children in care. Multiple staff confirmed the yelling from their colleague and described it as “frequent” and “forceful and angry to get children to follow instructions.” The staff member who yelled, was directly identified to LPA Poindexter, by name, by other staff. This individual confirmed to LPA Poindexter moments where they get “frustrated” and “get upset at small things” and “can feel the tightness in my body.” This staff member acknowledged that naptime and transitions were challenging moments. They also acknowledged that fellow staff members and the center director had at different instances, entered the classroom to “tell me I was yelling.”
LPA interviews with staff determined that within the current calendar year, 2025, possibly earlier, there were instances where staff members argued while children were present. One staff member spoke to LPA Poindexter about “clashes” they had with their superiors, and there was a “fair share of clashes” with one another. They added that “kids would see the clashes” and “parents maybe saw it on the cameras” (via access to the SproutAbout app). These moments were verified to LPA Poindexter by the other parties involved.
Based on the information obtained during interviews and documentation reviewed, it is determined that both allegations are valid because the preponderance of the evidence has been met. Therefore, the allegations are found to be SUBSTANTIATED.

Exit interview conducted and report was reviewed with Johana Herrera, interim center director. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights were provided. |
