32 | S1 stated that they observed C2 repeatedly asking C1 to share a ball with them, and C1 refused. This led to a physical altercation between the two, resulting in C1 being bitten on the leg. S1 stated that they witnessed the entire interaction unfold but did not intervene until they saw that the conflict had escalated. C1 stated to LPA that teachers do not allow them to play with C2 and remembered the incident in which they fought with C2 on the playground, resulting in them being bit on the leg.
It was alleged that on 07/01/2026, the facility failed to notify C1’s parent regarding the incident in which they were bitten. The Director explained that they were unable to notify the parent of the incident until the following day. Based on LPA review of facility policy, incident reports are created whenever an incident, accident, injury, illness, or observation occurs, and is to be reviewed with the parent upon pickup of the child. Based on interviews with the Director, staff, and parents, LPA determined that the parent of the child was told that there had been no incident upon picking up the child and did not review the incident report with the Director until the following day.
It was alleged that on 07/01/2026, the facility failed to render first-aid to C1’s bite. The Director stated that they were unsure if first-aid was rendered but remembered thinking that S1 had “taken care of everything”. According to LPA’s review of the facility’s handbook, bite wounds are to be gently cleaned with soap and water. Based on staff interviews, they are also trained to ice the area of the bite if bruising appears. Both S1 and C1 stated that this was not done following the altercation. Based on LPA observation, C1 did sustain bruising in the area where it was reported they got bitten.
Based on interviews conducted and records reviewed, the preponderance of evidence standard has been met; therefore, the above allegations are found to be SUBSTANTIATED. Per California Code of Regulations, (Title 22, Division 12 & Chapter 1) three (3) Type B citations are being on the attached LIC 9099-D.
Exit interview was conducted and this report was reviewed with Assistant Director, Angelica Valderrama. A Notice of Site Visit was provided and must remain posted for 30 days. |
