On August 28, 2024, at 12:31PM, Licensing Program Analyst (LPA), William Chancellor arrived unannounced to La Petite Incorporated (CCC) and met with Director (DIR) Michelle McKim to discuss the investigative findings of the allegation listed above. On August 22, 2024, at 9:10 AM LPA conducted a tour, took census of the CCC and gathered evidence relevant to the investigation. During the investigation, LPA made observations and conducted confidential interviews with six staff (S1-S6) . This complaint corresponds with complaint # 10-CC-20240730082535.
On August 16, 2024, a complaint was received alleging that Facility staff handled day care child in an inappropriate manner. Specifically, that Staff 1 (S1) pushed Child 1 (C1) into a corner and physically forced them to stop jumping while in line. Interviews and record review corroborated that S1 was in fact physical towards C1. Staff 2 (S2) witnessed the incident and Director McKim confronted S1. Immediately without being questioned, S1 became defensive and stated that they did not touch C1. Never showing signs of remorse or empathy towards C1 who was visibly shaken and emotional, S1 was escorted to the front office. Director McKim called Community Care Licensing (CCL) to report an Unusual Incident and notified C1 parents. Interview with S2 and C1 confirmed that S1, in fact did put their hands on C1 and forced them into a corner.

Based on confidential interviews and record review, the allegation that that Facility staff handled day care child in an inappropriate manner, the preponderance of evidence standard has been met and the allegation is substantiated. The facility is in violation of Title 22, Section 101223 (a)(3) Personal Rights, which poses an immediate health, safety and/or personal rights risk to children in care.

An exit interview was conducted, a copy of this report, 9099D & appeal rights, along with a Notice of Site Visit was handed to Director, Michelle McKim. Due to the Type A citation, an LIC 9224 was provided. The form must be signed by parents and kept on file. A notice of site visit was also provided and must remain posted for 30 consecutive days.

By COB 8/29/24, Director will email LPA proof that S1 has been disassociated from Guardian and timesheets to show S1 has not returned to CCC. Director will also email LPA a Personal Rights training or redirective strategies including a sign-in sheet.

Based on interviews and record review, S1 violated the personal rights of C1 by pushing the child into a corner in front of other daycare children and staff. This poses an immediate health, safety and or personal rights risk to children in care.
