32 | Surveillance footage confirmed that the door remained open for nine seconds, during which C1 walked toward the door and placed their finger in the door jamb. At the time of the incident, there were eleven (11) children and three (3) staff members outside. There is insufficient evidence to prove that the injury resulted from a lack of supervision.
The second allegation claimed that staff failed to properly report an incident involving a daycare child, specifically, alleging that facility neglected to call emergency personnel or follow protocol. The IB investigation confirmed that first aid was immediately provided, and that staff followed protocol, as the injury was considered “non-emergency.” CCC staff offered supplemental insurance to family and recommended calling 911 out of precaution; however, Parent 1 (P1) declined emergency response. Record reviews confirmed that the consent for medical treatment form on file listed the corresponding emergency rooms where staff transported the child in a timely manner. Additionally, CCC complied with reporting requirements by notifying CCL on September 17, 2024, the same day the injury occurred.
Based on surveillance, interviews and record reviews, the IB was unable to corroborate the allegations that staff caused injuries to a daycare child while in care or that staff failed to properly report the incident. Although the incidents may have occurred, there is not a preponderance of evidence to prove or disprove the allegations. Therefore, the allegations are determined to be unsubstantiated.
An exit interview was conducted with Director Michelle McKim. A copy of this report, along with Appeal Rights was provided.
Additionally, the Notice of Site Visit (NOS) was issued, and LPA Chancellor confirmed that it was posted in a prominent location visible to all parents and guardians.
