32 | It was alleged that on 11/22/2023, facility staff did not prevent daycare child #1 (C1) from being hit by another child and staff did not provide C1’s representative with an incident report.
All eight (8) staff interviewed denied the above allegations, stating they were unaware of any incident that may have resulted in an injury to C1. All staff interviewed stated they were in compliance with teacher child ratios and maintain visual supervision of children during operating hours. According to staff, injuries are tended to promptly and documented on Ouch Reports, which are provided to the parents. C1 was interviewed but did not state they had been hit by another child. Other children interviewed did not express any instances where children had hit another child and verbal skills were limited due to age. There were no other witnesses to the alleged incident and no documentation to support that a specific incident had occurred. Parents interviewed stated they have not observed any child receiving unexplained injuries, feel the children are well supervised, have no concerns and expressed a high level of satisfaction with the care their children receive. Photographic evidence received was inconclusive with no specific indication as to how, when or where the injury occurred.
Based on information obtained throughout the course of the investigation, LPA was unable to determine whether or not, a child altercation resulting in injury occurred at the facility. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the above allegation are UNSUBSTAINIATED.
Exit interview conducted and report was reviewed with Site Supervisor, Zenaida Lopez. A copy of this report, along with Appeal Rights (LIC9058), was provided. A Notice of Site Visit was given and must remain posted for 30 days. LPA observed that the Notice of Site Visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
