On 7/26/23 at 12:00 PM, Licensing Program Analyst (LPA) Adrian Mangina conducted an unannounced complaint visit for the complaint received on 5/2/23 for the purpose of delivering findings on the above referenced allegation. Upon arrival, LPA met with Assistant Director Sheana Pineda and conducted a brief inspection of the facility.
Census was as follows:
2's classroom- 18 napping children with one teacher
3's Classroom combined with pre-k 2- 23 napping children with two teachers
pre-K 1 Classroom- 24 napping children with two teachers

It was alleged that staff are operating over capacity. LPA conducted Interviews with staff, former staff, and parents of enrolled children. Director and Assistant Director denied during interviews that any classes operated out of ratio. Interviews with staff, former staff, and parents of enrolled children

witnesses believe that the facility has operated out of ratio.

LPA reviewed Name to Face sign in sheets for 5/1/23 through 5/9/23 and 6/7/23 through 6/14/23 for all classrooms and review revealed that on 5/1/23, 5/2/23, 5/4/23, 5/8/23 and 5/9/23 one or more classrooms were out of ratio for between 2 minutes and up to 152 minutes. LPA also found that on 6/12/23 between 7:35 AM to 9:06 AM there was one classroom with 15 children present and only 1 teacher supervising and that same class had 18 children and one teacher present from 9:06 AM to 10:30 AM.

Based on the information obtained during interviews, observations, and documentation reviewed it is determined that the facility does operate out of ratio. The allegation is valid because the preponderance of the evidence has been met, therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, Chapter 1 Article 6, Section 101216.3(a) the deficiency is being cited on the attached LIC 9099D.

Exit interview conducted with Director Lindsay Sweet and Notice of Site Visit was provided and posted.

LPA Mangina informed facility representative Lindsay Sweet that this report dated 7/26/23 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Mangina informed the facility representative, Lindsay Sweet to provide a copy of this licensing report dated 7/26/23 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be place in the child's file for verification.

Licensee states has hired 4 new teachers and 1 aid. Director states will provide enrollment lists and staff schedule for each class that shows adequate staffing for all classrooms at all times of day no later than close of business 7/27/23. Director states will in future abide by teacher child ratios.

Based upon interviews and review of Name to Face sign in sheets, it was determined that the facility operated preschool classrooms with a ratio of more than 12 children per one teacher for between 2 and 152 minutes on 5/1/23, 5/3/23, 5/4/23, 5/8/23, 5/9/23 and 6/12/23 which posed an immediate health, safety and personal rights risk to children in care.

revealed that no staff had witnessed flies in food. Based on interviews and observations, LPA was unable to corroborate the claim that staff did not keep facility free of flies..

Reporting party claimed that children are served meals that are not prepared and served in a safe and healthful manner. Reporting party claimed that kitchen staff served moldy bread to children and on one occasion picked a fly out of food that was served to children. During five visits to the facility, LPA was present facility during mealtime and did not witness any flies or moldy food. The food was of appropriate temperate and was always covered while staff was delivering food to classrooms and preparing to serve the food. During interviews, several witnesses stated that they had seen one or two flies enter the building during transitions from inside to outside but had never seen flies in food. Interviews also revealed that no staff had witnessed children being fed moldy food. One witness did say that one day there was a white substance found on bread that was scraped off and fed to the child, The witness stated that it was an unknown substance but not mold. Based on interviews and observations, LPA was unable to corroborate the claim that children were served meals that are not prepared and served in a safe and healthful manner.

It was alleged that sick children are allowed to remain in care. LPA interviewed staff and others who all stated that the facility has sick policy that prohibits sick children from attending the preschool and that sick children with fevers over 100.4, colored mucus, or excessive coughing must be picked up by parents. LPA conducted interviews with staff and others. Some reported that all sick children were sent home immediately and were removed to the Director's office while awaiting pick up. Other witnesses reported that sick children were allowed to remain in care. Due to conflicting testimony, LPA was unable to determine if the sick children were allowed to remain in care..

Based on the information obtained during interviews, observations, and documentation reviewed it is determined that the allegations above were UNSUBSTANTIATED. Although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
