On the above date and time listed, Licensing Program Analyst (LPA) Keely Messerschmidt arrived at the facility for the purpose of delivering the complaint findings on the above-referenced allegations. LPA met with Director Stephanie Mangione, informing her of the reason for todays visit. LPA toured the facility, conducted census, and verified facility staff and children enrollment.

On October 7th, 2024, Community Care Licensing (CCL) received a complaint alleging that facility does not ensure staff are trained in emergency evacuation procedures, facility does not ensure fire evacuation drills are conducted, that staff did not ensure that the playground was free from hazards, daycare children had access to toys that were not age appropriate and facility is operating out of ratio.

Based on interviews conducted when it comes to allegation that facility does not ensure staff are trained in emergency evacuation procedures, it was disclosed that when new staff have started they have expressed to teachers that they didn't know what to do in the case of an emergency evacuation, so the teacher will go over it with them. It was also stated that they believe these procedures are a part of on boarding but are unsure if staff are being trained. Based on interviewed conducted, two of six staff confirmed that these procedures were not being trained to staff. Based on record review, LPA observed training material on Emergency Response Process that was conducted on 10/14/24.

When it comes to allegation that facility does not ensure fire evacuation drills are conducted, based on interviews conducted it was disclosed that these drills have not been being completed on a regular basis but they are unaware of the frequency required. This allegation was confirmed by three of six staff members interviewed. Based on record review, LPA observed the last drills to have been conducted were on 6/11/24 and 10/30/24.

When it comes to allegation that staff did not ensure that the playground was free from hazards based on interviews conducted it was disclosed that there have been a few times where broken items were left on the yard, gopher holes that have caused tripping and wood chips not being swept up across the pavement. This allegation was confirmed by two of six staff members interviewed. Based on record review, LPA observed facilities Daily Playground Inspection spreadsheets for month of September and October seeing that inspections for hazards were being conducted and documented.

Based on interviews conducted when it comes to allegation that day-care children had access to toys that were not age appropriate, it was disclosed that each classroom is responsible for cleaning the yard before they go back inside and when this does not take place the large wooden blocks are left outside and the younger children do not play with them correctly. It was stated that the blocks are preferred not to be used for the younger preschoolers.

Lastly when it comes to the allegation that facility is operating out of ratio, based on interviews it was disclosed that each classroom remains in ratio and if a child arrives and the classroom is at their max capacity then they will either transfer a child to another classroom or ask the parent to wait until the next teacher clocks in. Based on record review of facilities Child Supervision Records (CSR), LPA reviewed random days in the months of August, September, October and November and observed classrooms to be in ratio.

Based on the information obtained during this investigation, it has been determined that although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violations did or did not occur. Therefore, the allegations are UNSUBSTANTIATED.

An exit interview was conducted, and this report was reviewed with the Director, Stephanie Mangione, and a copy was provided. Appeal rights were discussed and provided during the exit interview. A Notice of Site visit was given, and Director understands that it must remain posted for 30 days.
