On the above date and time, Licensing Program Analyst (LPA) Kelly Gerth conducted an unannounced visit and met with Oakhill Child Development Center/NCCS (CCC) Site Supervisor Zoila Mendoza to deliver the findings from a complaint made to Community Care Licensing (CCL) on October 08, 2024. The complaint CCL received stated the following allegation: Staff member handled day care child in a rough manner while in care.
On 10/10/2024, LPA Kelly Gerth made an unannounced visit to conduct investigations regarding the complaint of the above allegation. During the investigation, confidential interviews were conducted with Staff (S1, S3-S6) and evidence collected. LPA obtained copies of pertinent records that included: facility roster of personnel, roster of enrolled children, parent handbook, incident reports, written statements, behavior reports and communication records.
On 10/10/24 and 10/11/24 additional confidential interviews were also conducted (P1, RP), (S10) and evidence gathered, including communication records and pictures from the dates surrounding the alleged incident.

On 10/30/24, LPA Gerth made a subsequential visit to the CCC to conduct confidential interviews with additional staff (S2, S7) and children (C2-C5), regarding the allegation made. LPA also reviewed pertinent files and documentation and on 11/14/24 LPA Gerth conducted a collateral interview with Child 1 (C1).
Regarding the allegation that a Staff member caused injury to day care child while in care, specifically that a staff member bruised a child’s ear. During the investigation, conflicting information in interviews revealed that it cannot be confirmed which ear the staff member had pinched, right or left, as well as which area of the ear was pinched, the upper or lower portion. Additionally, the date(s) also could not be confirmed as to when an alleged injury may have occurred to the child’s ear. Therefore, based on confidential interview, evidence gathered, and documents obtained during the investigation, a preponderance of evidence cannot be met and there for the allegation that a Staff member caused injury to day care child while in care, is unsubstantiated.

A copy of this report, appeal rights and Notice of Site Visit were provided to Site Supervisor Zoila Mendoza and was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.

LPA also reviewed pertinent files and documentation and on 11/14/24 LPA Gerth conducted a collateral interview with Child 1 (C1).

The allegation that a staff member handled daycare child in a rough manner, specifically that a staff member pinched a child on the ear while in care at the CCC, was confirmed to have occurred by staff members at the CCC as well as the child involved. While interviews with other children in care revealed that they had not experienced this type of handling, the preponderance of evidence including the admission of the CCC does support the findings that a staff member pinched a child while in care.

Although all parties involved have stated that the staff members intent was to teach the child calming techniques through a light grasping pinch of the ear, the personal rights violation did occur. Therefore, based on interviews conducted, observations and evidence collected, LPA Gerth was able to corroborate this allegation. The allegation that a staff member handled daycare child in a rough manner is substantiated.

An exit interview was conducted and a copy of this report along with appeal rights were provided to Site Supervisor Zoila Mendoza, A notice of site visit was also provided and must remain posted for 30 days.
