On 10/30/24, LPA Gerth made a subsequential visit to the CCC to conduct confidential interviews with additional staff (S2, S7) and children (C2-C5), regarding the allegation made. LPA also reviewed pertinent files and documentation and on 11/14/24 LPA Gerth conducted a collateral interview with Child 1 (C1).
Regarding the allegation that a Staff member caused injury to day care child while in care, specifically that a staff member bruised a child’s ear. During the investigation, conflicting information in interviews revealed that it cannot be confirmed which ear the staff member had pinched, right or left, as well as which area of the ear was pinched, the upper or lower portion. Additionally, the date(s) also could not be confirmed as to when an alleged injury may have occurred to the child’s ear. Therefore, based on confidential interview, evidence gathered, and documents obtained during the investigation, a preponderance of evidence cannot be met and there for the allegation that a Staff member caused injury to day care child while in care, is unsubstantiated.
A copy of this report, appeal rights and Notice of Site Visit were provided to Site Supervisor Zoila Mendoza and was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. |
