On 08/22/2025 at 9:05AM, Licensing Program Analyst (LPA), Saul Zazueta conducted an unannounced complaint inspection regarding the above allegation(s). Upon arrival, LPA met with Director, Ana King and discussed the purpose of the inspection, the complaint process and was led on a tour of the facility. There were forty-two (42) children and eleven (11) staff present during the inspection.

During the course of the investigation, LPA conducted interviews with the director, staff, and daycare parents. LPA did not conduct child interviews due to lack of verbal ability in infant children. Child Supervision Records (CSRs), and facility roster were obtained and reviewed by LPA.

Based on interviews conducted and records reviewed, it was determined that on 06/09/2025, and again on 06/10/2025, the facility was operating out of ratio, in classroom Toddler A, there was one (1) staff supervising five (5) children for a duration of up to two (2) minutes. Four (4) out of five (5) staff interviewed admitted that the facility has recently operated out of ratio, on multiple occasions and expressed concerns with staffing at the facility.

Based on interviews conducted and records reviewed, the preponderance of evidence standard has been met; therefore, the above allegations are found to be SUBSTANTIATED. Per California Code of Regulations, (Title 22, Division 12 & Chapter 1) one (1) Type B citation is being cited on the attached LIC 9099-D. A Civil Penalty in the amount of $250 for a repeat violation was assessed during today’s inspection.

Exit interview was conducted and this report was reviewed with Director, Ana King. A Notice of Site Visit was provided and must remain posted for 30 days.

Director stated that they will personally supervise staff in Toddler A and provide 1:1 training to ensure Care Supervision Records are recorded accurately. Director stated that they will initial Toddler A CSRs and submit two weeks worth to the San Diego Regional Office (SDRO) by 09/19/2025.

Based on LPA interviews conducted, and records reviewed, the facility did not comply with the section cited above as they had a ratio of one (1) staff to five (5) infants, for up to two minutes, on two separate occasions, which poses a potential health, safety, and personal rights risk to children in care.

Upon arrival, LPA met with Director, Ana King and discussed the purpose of the inspection, the complaint process and was led on a tour of the facility. During the course of the investigation, LPA conducted interviews with the director, staff, and daycare parents. LPA did not conduct child interviews due to lack of verbal ability in infant children. Incident Reports, staff sign in sheets, and facility roster were obtained and reviewed by LPA.

It was alleged that on 06/02/2025, staff did not provide adequate supervision resulting in a child biting another child in care twice on the same day. Director denied the allegation, stating that staff are trained to be proactive in preventing children from biting each other.

Five (5) out of five (5) staff interviewed identified the same children that are likely to bite and are aware of the risks of biting for the age group. Staff interviewed shared similar procedures in mitigating biting and expressed the importance of supervision. Based on document review, the facility was in ratio during incidents of biting and reporting requirements were met. Parents interviewed stated that they believe the facility provides a safe environment for children and are satisfied with the program and staff.

Due to the disposition of the infant age group to bite and the statements provided by staff, LPA is unable to determine whether or not there was a lack of supervision at the time of the incident. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.
