13 | On 06/03/26 at 11:30AM, Licensing Program Analyst (LPA) Luigi Gargaro conducted a complaint finding delivery visit with facility site supervisor Brenda Patty regarding the above allegation. During the course of the investigation, analyst conducted interviews with the facility site supervisor, facility staff and day care parents and children. Analyst also reviewed facility documentation as relevant evidence to the investigation.
Based on the information gathered, the allegation could not be conclusively proved or disproved as child alleged to have condcuted behaviors was not specifically identified. While there were children identified who demonstrate some behavioral issues, there were none who were reported to have caused injuries to other children and children did not disclose concern regarding any behaviors. However, as behavioral issues were corroborated as occurring in some children, analyst could not definitively say that behaviors never caused any type of distress or were always sufficiently addressed.
While disregulated behaviors were reported as occurring, facility provided evidence that staff has training to attempt to address them, has planned interventions for them and has made referrals to provide assistance to children who have been identified as needing it. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated. |
