On 2/21/2023, at 8:50a.m., Licensing Program Analyst (LPA), Cindy Meier conducted an unannounced Annual Inspection and met with Licensee, Oletta Silas. LPA disclosed the purpose of the inspection and was led on a tour of the facility indoors and outdoors. This facility is a one story, three-bedroom, two-bathroom house. The following areas are used for childcare: family room, bedroom #2, bathroom #2 and front yard. Off limits areas include: kitchen, garage, bedroom #1, bedroom #3, bathroom #1 and backyard which are made inaccessible through the use of locks and baby gates. The fireplace located in the living room is inaccessible to children.
Hours of operation hours are Monday – Friday 6:00a.m. to 6:00p.m. There were no children present. Licensee and licensee’s mother, who is visiting, were present during the inspection. Licensee stated she has not provided care to children since 2019, although the facility file does not reflect this information. Licensee stated there was a fire in the kitchen in April 2022 which was not reported to licensing. No children were present.

The licensee did not have a fire extinguisher or smoke detector available during the inspection. The carbon monoxide detector met requirements. Hazardous items were inaccessible to children in care. LPA informed licensee poisons shall be placed in a storage area and locked. LPA did not observe any poisons during the inspection. The storage area for poisons is locked. LPA observed toys and materials available for children’s use. The home uses the front yard for outdoor activities. The front yard is not fenced. LPA informed licensee that children need to be supervised at all times during outdoor activities. Licensee stated there are no bodies of water and LPA did not observe any bodies of water during the inspection. Licensee stated there are no firearms, other weapons or ammunition in the home.

A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions.

LPA did not review children’s files as licensee has not provided care for children since 2019. No children’s files were available. LPA informed licensee once she begins providing care, all requirements for children’s records will need to be maintained, along with a Facility Roster.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Licensee’s Mandated Reporter AB1207 training and CPR & First Aid certificates have expired. Licensee’s immunizations were not available for review. Facility roster is not maintained due to not providing care for children. Fire and disaster drills have not been conducted since 2019. Technical Assistance was provided. Required documents were not posted.

Incidental Medical Services (IMS) policy were discussed. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA and licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov. Per California Code of Regulations, (Title 22, division 12 & Chapter 3) five (5) Type B citations and two (2) Technical Assistances are being cited on the attached LIC 809-D.

Exit interview conducted and report was reviewed with licensee, Oletta Silas. A copy of this report, along with Appeal Rights (LIC9058), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
