On 12/12/23 at 10:30 AM, Licensing Program Analysts (LPAs) Keturah Lane and Sherlynn Banas conducted an unannounced case management visit to cite for deficiencies observed while at the facility for another reason. Upon arrival, LPAs were greeted by Maria Elena Ramirez and toured the facility. Present were Licensee, Licensee helper Maria Castenda, adult daughter Geome Ramirez and 12 children in care, including 4 infants. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. LPAs observed appropriate capacity and ratio while at the facility.

Licensee has provided adequate space for the children to eat, sleep and play within the home. Areas used for childcare include: living room, dining room, family room, kitchen and downstairs ½ bathroom. Off limits areas include: entire second story which includes 3 bedrooms and additional bathroom and are inaccessible through use of a safety gate at the bottom of the stairs. The home has a fenced backyard available for outdoor activities.

During this visit, LPAs observed a 6-month sleeping in a play yard that was completely swaddled with a blanket. The head was not covered, but the arms were not free. Licensee stated that the child will not sleep unless he is swaddled. Infant does not have a medical exemption. LPA explained that the regulations do not allow infants to be swaddled while in care. Licensee also stated that she has not been completing the sleep logs because there is so much to do and not enough time to complete them. LPA provided an updated sleep log with multiple entries on the same page to make it easier for Licensee to meet this requirement. LPAs also reviewed children’s records and did not find any sleep logs completed except for a couple of days in October. (continued on LIC809-C...)

Also, on 6/28/23, Licensee was cited Type B deficiencies for not having sleep logs completed for infants in care, three children were missing immunizations in their records and mandated reporter training was not renewed. LPAs observed mandated reporter training was completed on 7/26/23. Licensee was able to show LPA the immunizations for the three children cited back on 6/28/23. However, Licensee is still not completing sleep logs for infants in care.

LPAs discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPAs also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPAs Keturah Lane and Sherlynn Banas informed licensee Maria Elena Ramirez that this report dated 12/12/23 documents 1 Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPAs Keturah Lane and Sherlynn Banas informed the licensee to provide a copy of this licensing report dated 12/12/23 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Pursuant to Title 22 of the CA Code of Regulations, the following Type B deficiency was also cited (refer to LIC 809-D).

Exit interview conducted and report was reviewed with the licensee, Maria Elena Ramirez. Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Licensee immediately removed the blanket from the child. Licensee stated that she will explain to the mother that the child cannot be swaddled while in care.

Based upon LPAs observation at the facility, a 6-month infant was sleeping in a playpen and was completely swaddled (unable to move his arms) which is an immediate health, safety and personal rights risk to children in care.
