On September 16th, 2024, at 7:50 AM, Licensing Program Analyst (LPA) Jo Ann Legaspi conducted an unannounced Annual Random Inspection and met with the Licensee Silvia Cardenas. LPA disclosed the purpose of the inspection and was granted facility entry by Staff Jessica De Santiago. Licensee Raul Cardenas soon returned to the facility after conducting morning child transportations. The licensees Silvia & Raul Cardenas, the helper and four (4) children were present in the facility during this inspection. This facility is a three (3) story, four (4) bedroom, four (4) bathroom house. Licensee Raul Cardenas accompanied LPA during this inspection. The following areas used for childcare are: the downstairs – dining room, family room, one downstairs bathroom, one outside bathroom and the fenced and shaded backyard. This home has an open floor concept with the kitchen, dining room and family room areas. Kitchen cabinets have cabinet locks. The off-limit areas are the living room, garage office and upper floors. Stairs to the living room, garage and the upper floors are barricaded with child safety gates.

The fire extinguisher, smoke detector, and carbon monoxide detector met requirements. Hazardous items were observed inaccessible to children during this inspection. The Licensees have available toys, play equipment and materials. Licensees states children engage in outdoor activities in the fenced and shaded backyard. Licensees were reminded that continuous supervision is to be given to children whenever engaged in outdoor activities. No bodies of water were observed on the premises during the inspection. Firearms are appropriately stored as required by regulation. Three (3) small dogs are kept inaccessible to children in the side yard which is barricaded with a fence.

Licensees’ First Aid and CPR certifications expire on 03/2025 and 08/2026. The helper’s First Aide and CPR certifications expire in 01/2026. Mandated Reporter Training was completed on 04/05/2023, 08/26/2024 and 08/26/2024. The helper completed the Mandated Reporter Training on 03/28/2024. The facility roster is maintained and was reviewed. The last fire and disaster drills were conducted and documented on

Licensees were reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Childcare Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Licensees were reminded that licensees shall be present in their home and shall ensure that children in care are supervised at all times. Licensees were also reminded that when circumstances require a licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult, who is background cleared and associated to the license, to care for and supervise the children during their absence. Licensees
acknowledged that temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day.

On this date, 08/26/2024, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility address. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. During the exit interview, the Licensees Raul & Silvia Cardenas, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

LPA discussed the safe sleep regulations with licensees and discussed the Childcare Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensees of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPA provided Licensee with Provider Information Notice (PIN) 20-24-CCP, a blank LIC 9227 “Individual Infant Sleeping Plan” form and two (2) examples of safe sleep logs.

LPA reviewed with licensees the LIC 311D, Forms/Records to Keep In Your Family Childcare Homes, children’s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the licensee. LPA reminded Licensee of the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, and ensure that all adults residing or working in the home have criminal background clearances or exemptions. Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensees were informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. No deficiencies observed. A notice of site visit was given to licensees and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Exit interview conducted and report was reviewed with the Licensees Raul & Silvia Cardenas.
