On October 30, 2024 at 10:00AM, Licensing Program Analyst (LPA), Luigi Gargaro, conducted an unannounced annual required inspection and met with the licensee, Gloria Torres Garcia. LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee. Four (4) children and two (2) staff were present in the facility during this inspection and included the licensee and helper Patricia Sanchez Moreno. This facility is a one story, four bedroom, three bathroom house. Licensee accompanied LPA inside and out of the facility during this inspection. The following areas used for child care are: the kitchen, the dining/living room area, the fourth bedroom (used as a day care room) and the two day care bathrooms located in the main part of the home. Off limits areas are the remaining three home bedrooms and the third bathroom and the home garage. The remaining three bedrooms and the third home bathroom are made off limits with a locking entry door that leads to the part of the house that contains them. The entrance door to the off limits garage is located in one of the off limits bedrooms. Since analyst's last inspection visit, the licensee has made the kitchen and the bathroom inside the day care room accessible, for use areas. Licensee will submit a new facility sketch reflecting the current for use and off limits areas in her home to Licensing within 30 days to have an updated reference for her facility file.

The fire extinguisher, smoke detector, and carbon monoxide detector met requirements. Most hazardous items were inaccessible to children. The licensee has toys, play equipment and materials available. The home has a fenced backyard available for outdoor activities. The yard is sectioned by picket fencing into three separate areas. No bodies of water observed on the premises during the inspection. Licensee stated there are no weapons in the home. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. Licensee’s First Aid and CPR certifications expire in January of 2025 while her assistant, Patricia Sanchez Moreno's, expires in November of 2024. Licensee has required immunizations. Licensee completed Mandated Reporter Training on 06/05/24 while Ms. Sanchez completed hers on 08/08/24. Facility roster is maintained and was reviewed. Licensee last conducted required emergency drills in September of 2024.

Based on analyst observation, the licensee did not comply with the section cited above as during today's visit the kitchen cabinet beneath the sink was unlatched and contained various cleansers while a unlatched kitchen drawer contained knives which poses/posed a potential health, safety or personal rights risk to children in care.

The violation was cited as a type B violation as the cleansers were all properly sealed and the children had a strong two provider to four children supervision ratio today. The licensee removed all the hazardous items today and moved them to an inaccessible area, however, states she will install latches in the cabinet and drawer and send analyst a photo of their installation by 11/04/24 to complete the correction.

The deficiency was corrected today as licensee removed all the attached toys leaving the playpen clear of any items. Licensee understands that an infant's sleeping equipment (play yard, crib, bassinet, etc.) must always be free of any items in or around it.
Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.

There is one crib or play yard for each infant who is unable to climb out of the crib or play yard. Cribs or play yards were not free from articles attached to their sides today. The provider physically checks on sleeping infants every 15 minutes. An Individual Infant Sleeping Plan [LIC 9227 (3/20)] is maintained for each infant up to 12 months of age. The provider places infants up to 12 months of age on their backs for sleeping.

LPA provided and discussed the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, and ensure that all adults residing or working in the home have criminal background clearances or exemptions. Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare. Licensee was also provided handouts with information regarding upcoming Safe Sleep Regulations/SIDS, Lead exposure and Shaken Baby Syndrome. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov.

LPA discussed and provided Licensee with the following: child care advocates email address: childcareadvocatesprogram@dss.ca.gov . In addition, for general questions or questions regarding licensing requirements contact the Child Care Licensing Duty Line at (619) 767-2248.

Incidental Medical services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Two type B deficiencies California Code of Regulations, (Title 22, Division 12 & Chapter 3), are being cited on the attached LIC 809-D.

An exit interview was conducted with the licensee, Gloria Torres Garcia. The licensee was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.

LPA provided notice of site visit and observed it being posted at the facility.
