13 | On 11/05/25 at 10:10AM, Licensing Program Analyst (LPA) Luigi Gargaro conducted a complaint finding delivery visit with licensee Gloria Torres Garcia regarding the above allegations. During the course of the investigation, analyst conducted interviews with the licensee, the licensee’s assistants, day care parents and children in care.
Based on the information gathered, there was no corroborative evidence or testimony from all parties interviewed that there were illegal substances found in the home or that there were any adults in the facility that presented a risk to children in care. Based on competing testimony, analyst could also not definitively state whether there were never any instances of licensee not adequately supervising day care children or yelling at them or handling them in a rough manner.
Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
An exit interview was conducted and the report was reviewed with licensee Torres Garcia. A copy of this report, along with Appeal Rights (LIC9058 01/16), was provided. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
