32 | stating they have never spanked C1 or any other child. C1 was non-verbal and unable to be interviewed due to age. Two (2) current daycare children and two (2) former children interviewed denied the allegation, stating they had never observed the licensee or assistant spank or hit children, nor had been spanked by licensee or assistant; however, former daycare child #2 (C2) reported that the licensee had spanked their hand and C2’s hand on multiple occasions. Daycare parents interviewed stated they have not observed staff hitting children. Parents expressed a high level of satisfaction with the care the licensee provides, stated their children have not mentioned the licensee yells, spanks, or hits.
It was also alleged that the licensee yells at daycare children on a daily basis. The licensee and assistant both denied the allegation, stating they do not yell at the children. Licensee denied the allegation; however, the licensee admitted that the tone of her voice is strong and loud, which could be perceived by others as though she is yelling. The assistant stated the licensee has a strong voice but can tell the difference between yelling and being firm and has never heard the licensee yell at daycare children. Two (2) current daycare children and two (2) former children interviewed denied that the licensee yells; however, one (1) former child confirmed the licensee has a loud voice but does not consider it to be yelling and denied that they are threatened or frightened by the tone the licensee uses.
Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegations are UNSUBSTANTIATED.
Exit interview was conducted and the report was reviewed with Licensee, Irene Santiago. A Notice of Site Visit was given and must remain posted for 30 days. |
