13 | On 8/2/24 at 8:15 AM, Licensing Program Analyst (LPA) Annette Sutherland conducted an unannounced complaint inspection to deliver findings regarding the above allegations. LPA Sutherland met with Licensee Matilde Gonzalez. Census was 6 children.
The Department fully investigated the above allegations and obtained information from interviews with reporting party, parents, staff member and Licensees.
LPA conducted numerous visits and did not witness any inappropriate interactions between children or lack of supervision. LPA witnessed children having craft time, snack time and outdoor playtime. The allegation regarding child left unsupervised may have occurred 2-3 years ago. LPA was unable to verify who that child could have been and was unable to confirm it ever occurred. There is however chain link short fence in the backyard, but the children know not to climb on it. Licensee stated there was a child a few years back that climbed the fence but did not climb over and was told not do that again and it never happened again. Licensee uses equipment as intended for by the manufacturer, and LPA did not witness any infants restrained in highchairs. Based on staff, parents interviews, the above-referenced allegations could not be conclusively proven or disproven. Therefore, they are considered Unsubstantiated. A finding that the complaint is Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. No deficiencies are cited. An exit interview was conducted with the Licensee. A Notice of Site Visit (LIC9213) and Appeal Rights (LIC9058) was provided along with the report (LIC9099) to the Licensee. LPA Sutherland observed Notice of Site Visit being posted. Notice of Site Visit must be posted for 30 days.
