32 | denied the allegation, stating that the booster seat had only been used while attached to a dining room chair. The licensee later acknowledged that she had, on occasion, placed the booster seat on the glass-top table and stated that the children were never in danger. LPA was unable to interview the children due to their limited verbal abilities based on their age. LPA attempted to interview daycare parents. According to the Graco Swivi Seat 3-in-1 Booster user manual, failure to follow the warnings and assembly instructions could result in serious injury or death. The user manual further states that the booster seat should not be used if it cannot be securely and safely attached to an adult chair.
Based on the licensee's admission, observations, and the manufacturer's instructions, the preponderance of evidence standard has been met, therefore the above allegation(s) are/is found to be substantiated. California Code of Regulations, title 22, Division 12 & Chapter 3, is being cited on the attached LIC 9099D.
LPA Abrego informed licensee Teresa Garcia that this report dated 06/24/2026 documents one (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Abrego informed the licensee to provide a copy of this licensing report dated 06/24/2026 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with the licensee, Teresa Garcia. A notice of site visit was given and must remain posted for 30 days. |
