On 02/24/25 at 9:45AM, LPA Luigi Gargaro conducted an unannounced annual required inspection and met with the licensee, Rosa Villegas. Ms. Villegas understands and speaks some English but her husband, cleared and associated Filemon Villegas, assisted with translation today. LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee. No (0) children and just Ms. Villegas and her husband were present in the facility during this inspection. Licensee stated that she primarily cares for school age children but that the non-school age children who do attend come to the facility on a drop in basis depending on their parents' schedules. This facility is a one floor, two bedroom, one bathroom house. Licensee accompanied LPA inside and out of the facility during this inspection.

The following areas used for child care are: the kitchen, the living room, the first bedroom and the bathroom. Off limits areas are: the master bedroom and the small outdoor laundry area before the main yard that contains laundry equipment and other personal items. The master bedroom is made inaccessible through use of a door lock. The outdoor laundry area before the yard is made off limits with a locking kitchen door and a picket fence that separates the play yard from laundry area. Children do not walk through the laundry area to get to the play yard. They are escorted through the front gate so they do not access the laundry area. The licensee has toys, play equipment and materials available. The home has a fenced backyard available for outdoor activities. The yard has a detached residential structure, which is off limits to the day care, where the licensee's cleared and associated son, Yoel Villegas, resides. The residence is made off limits with metal gated and entry doors that have locking door handles.

No bodies of water observed on the premises during the inspection. Licensee stated there are no weapons in the home. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions.

Licensee’s and spouse's First Aid and CPR certifications expire in July of 2025. Licensee has required immunizations. Licensee and spouse do not have current Mandated Reporter Training certifications. Facility roster is maintained and was reviewed. The licensee has not conducted fire and disaster drills within the last six months as required.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan. As their age and ability permit, newly enrolled children shall be informed promptly of their duties as required in the plan. Licensee was not aware that napping records must be kept for infants from 12-24 months and was not keeping them for the older infants she currently has enrolled. Analyst provided licensee with a copy of a sample safe sleep log. Licensee states she will begin observing and documenting all her infants napping starting tomorrow, 02/25/25, for all her three infants in care and submit copies of the records she keeps for one of the children of her choice, for the period of 02/25/25-03/07/25, to analyst by 03/10/25 to complete the correction.
Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.

There is one crib or play yard for each infant who is unable to climb out of the crib or play yard. Cribs or play yards are free from all loose articles and objects. The provider physically checks on sleeping infants every 15 minutes but has not been maintaining a safe sleep log as required for them. An Individual Infant Sleeping Plan [LIC 9227 (3/20)] is maintained for each infant up to 12 months of age. The provider places infants up to 12 months of age on their backs for sleeping.

LPA provided and discussed the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, and ensure that all adults residing or working in the home have criminal background clearances or exemptions. Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare. Licensee was also provided handouts with information regarding upcoming Safe Sleep Regulations/SIDS, Lead exposure and Shaken Baby Syndrome. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov.

LPA discussed and provided Licensee with the following: child care advocates email address: childcareadvocatesprogram@dss.ca.gov . Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Three type B violations California Code of Regulations, (Title 22, Division 12 & Chapter 3), are being cited on the attached LIC 809-D.

An exit interview was conducted with the licensee. The licensee was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. A notice of site visit was provided by the LPA and must remain posted for 30 days.
