On 12/27/2024 at 9:15 am, Licensing Program Analysts (LPAs) Danielle Anderson & Michelle Hood conducted an unannounced complaint inspection regarding the above allegations. LPAs met with the helper, Yajaira Paulina Garcia Cardoza, however the licensee Esperanza Martinez arrived 20 minutes after the LPAs arrival. LPA Hood explained the purpose of the inspection was to attempt to interview daycare children and deliver the complaint findings. LPAs observed one infant and one school age child. During today's inspection LPAs were able to interview one daycare child.

During the investigation, LPAs Hood and Anderson interviewed the licensee, the licensee’s helpers, Reporting Partys (RPs) and daycare parents and daycare children. Both the licensee and helpers denied the allegations. Daycare child and daycare parents did not disclose any information indicating that the licensee does not provide adequate food service. Daycare child that was interviewed stated they observed the licensee spank a child, however another daycare child interviewed stated they never observed the licensee spank or yell at children.

 A finding that the complaint is UNSUBSTANTIATED means that although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred. The licensee was provided with a copy of their appeal rights (LIC 9058 03/22) and their signature on this form acknowledges receipt of these rights. Notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
