On 09/04/2024 at 10:14 am, Licensing Program Analysts (LPA) Oscar Picazo and Licensing Program Manager Tulam Vu conducted an un-announced annual/required inspection with Licensee, Dulce Rodriguez. The purpose of the inspection is to ensure the home is in compliance with the standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. Also present during the inspection was 1 assistant and 6 day care children 2 of whom are infants. This 2 story 4 bedroom, 3 bathroom home was toured and inspected. Days and hours of operation are Monday through Friday, 8:00am - 4:15pm. Licensee will utilize the following areas for childcare: downstairs living room, kitchen, dining room, hallway bathroom and back yard. Off limit areas include the entire 2nd story, Master bedroom and 2nd bedroom. Off limit areas are made inaccessible to children by use of a child proofed locking barrier gate at the bottom of the stairs, locked door knob and safety latches and cabinet locks. Licensee utilize the fenced backyard for outdoor activities. Licensee stated that she will ensure children are supervised at all times during outdoor activities.

Licensee stated there is a swimming pool located on the premises. LPA observed one in- ground swimming pool in the backyard of the premises. The fencing consists of vertical metal bars that are 5 feet and 1.5 inches high from the cement ground, with no more than 4-inch gaps between each bar and does not obscure the pool from view. There are 2 gates that are self-latching devices that pull away from the pool and that are self-latching from any distance it opens. LPA observed that a 6 ft portion of the fence surrounding the pool is missing on the east side of the home making the pool accessible to children. Licensee stated the fence was removed about a month ago in order to better access the east side yard of the home. Licensee placed a large storage bin measuring 3 Ft by 6 ft in its place.

The fire extinguisher is rated 3-A:40-B:C and is located in the kitchen, smoke and carbon monoxide detectors meet requirements and are operational. Poisons, detergents, cleaning compounds and other hazardous items are locked and made inaccessible. See 809-C Continuation...

There is a gas fireplace in the home that is located in the living room that is screened and made inaccessible. Licensee has children's toys, play equipment and books available. The licensee has a working cell phone. Licensee stated there are no firearms, other weapons or ammunition in the home.

A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances.

LPA reviewed children’s files. Children’s files reviewed were complete and met regulations.

Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5- days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

Licensee’s Mandated Reporter AB1207 training expires 02/26/2026. Pediatric CPR and First Aid certifications expire on 08/2025. Licensee owns the home. Proof of ownership (Deed) was viewed and verified during the inspection.

Facility roster is maintained and was reviewed. The last fire and disaster drills were conducted and documented on 04/12/2024. LPA observed all required documents were posted.

Incidental Medical Services (IMS) policy was reviewed. Licensee stated that she is currently not providing IMS at this time. For IMS information see PIN 22-02-CCP. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

On this date, 9/04/2024, the California Attorney General - Megan’s Law website (meganslaw.ca.gov) was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.
Licensee was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.

Type A deficiency and a $500 civil penalty is assessed during today's inspection, see LIC809D and
LIC 421IM.

LPA, Oscar Picazo informed Licensee Dulce Rodriguez, that this report dated 09/04/24 documents 1 Type A deficiency which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA informed the licensee to provide a copy of this licensing report dated 09/04/24 that documents any Type A deficiency to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A copy of the report and appeal rights (LIC 9058) was provided to the Licensee and notice of site visit (LIC9213) was given to Licensee and was advised it must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Licensee stated she will be reinstalling the portion of the 5 ft fence with a gate that swings away from the pool that is self closing and self latching that was removed last month. Licensee also stated she will insure and not be allowing children out in the play area which is also where the pool area is located. Licensee will send proof of correction via picture to the Licensing office by 09/05/24.
