On 12/17/2024 at 9:10 a.m. Licensing Program Analysts (LPA’s), Cindy Meier and Saul Zazueta conducted an unannounced complaint inspection to deliver the findings for the above allegation. LPA met with Licensee, Erica Pastenes, and advised licensee of the purpose of the inspection and conducted a tour of the facility.
There were three (3) children present during the inspection.

During the course of the investigation, interviews were conducted with licensee, S1, daycare children and daycare parents. Photographs and facility roster were obtained and reviewed by LPA.
Based on LPA observations and interviews conducted it was determined the licensee did not maintain the cleanliness of the facility backyard. During the inspection conducted on 11/01/2024, LPAs observed an excessive amount of dog feces throughout the grass in the backyard, in areas where daycare children play. Licensee stated the backyard had been cleaned three (3) days prior to the inspection; however, S1 stated the backyard had not been cleaned in approximately two (2) weeks. reported observing the licensee’s dog relieving itself in the backyard in the presence of children on multiple occasions.

Based on LPA’s observations and interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Per California Code of Regulations, (Title 22, division 12 & Chapter 3) one (1) Type A citation is being cited on the attached LIC 9099-D.

LPA Cindy Meier informed Licensee, Erica Pastenes that this report dated 12/17/2024 document(s) (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Cindy Meier informed the Licensee, Erica Pastenes to provide a copy of this licensing report dated 12/17/2024 that documents Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.

included an art easel with a broken plexiglass cover. Licensee stated that until the items are removed, extra attention and supervision is given, and the children are instructed to play in other areas of the outdoor backyard. LPAs observed the fire pit to be in good condition and mounted on solid concrete blocks. Parents interviewed did not communicate any concerns and are satisfied with the care their children receive. During today’s inspection, LPAs observed the items had been removed from the facility.

Although LPAs observed the presence of some play equipment in disrepair, LPA was unable to determine, whether or not, daycare children actively used the equipment in its current state. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Licensee stated she will document on a log when the backyard is inspected each day, and any necessary cleanup will be conducted before the children go outside and play. Licensee will submit the log for 12/18/24 to 12/20/24 and 1/6/25 to 1/10/25 SDRO by 1/15/2025.

Based on LPA observations and interviews conducted, the licensee did not comply with the above regulation, as the licensee did not maintain sanitary conditions in the backyard where children play which might endanger a child, which poses an immediate Health & Safety risk to children in care.
