On 07/16/2024 at 11:55 a.m. Licensing Program Analyst (LPA), Cindy Meier conducted an unannounced complaint inspection to deliver the findings of the above allegation. LPA met with Licensee, Fidelia Mederos and advised licensee of the purpose of the inspection and conducted a tour of the facility. There were nine (9) children and licensee’s adult daughter, (S1) present during the inspection. S1 assists with the day care and provided translation for licensee during the inspection.

During the course of the investigation, interviews were conducted with licensee, S1, day-care parents and one (1) day-care child. Other day care children were not interviewed due to age. The facility roster was obtained and reviewed by LPA.

Based on interviews conducted, it was determined that on multiple occasions, when child (C1) arrives at the facility in the morning, sleeping in the car seat, both licensee

and S1 stated they leave C1 in the car seat between 30 minutes to one (1) hour until C1 wakes up and then take C1 out. Both licensee and S1 admitted to this practice and stated they do not want to disturb C1’s sleep. Licensee and S1 denied that C1 is put in the car seat at other times throughout the day. LPA observed play yards available for infants to sleep in.

Based on licensee and S1’s admission, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

Per California Code of Regulations, (Title 22, division 12 & Chapter 3) one (1) Type A citation is being cited on the attached LIC 9099-D.

LPA Cindy Meier informed Licensee, Fidelia Mederos that this report dated 7/16/24 document(s) (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Cindy Meier informed the Licensee, Fidelia Mederos to provide a copy of this licensing report dated 7/16/24 that documents Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.


A copy of this report, along with Appeal Rights (LIC9058 03/22), were provided.

Licensee and S1 stated they will immediately transfer any day care children from the car seat to either a play yard, if sleeping, or activity area. Licensee and S1 stated they will also review PIN 20-24-CCP regarding Safe Sleep regulations and submit a summary to SDRO by 7/23/24.

Based on Licensee and S1’s admissions, Licensee did not comply with the above regulation, as a day-care child is left in a car seat between 30 minutes to one (1) hour after arriving until day care child wakes up which poses an immediate Health & Safety and Personal Rights risk to children in care.
