On March 20, 2025 at 12:45 p.m., Licensing Program Analyst (LPA) Adrian Castellon conducted an unannounced Annual/ Random Inspection and met with the Licensee Nuptce Pati Maldonado. Licensee arrived more than an hour after LPA's arrival. LPA disclosed the purpose of the inspection and was granted facility entry by the facility assistant Erika Cuevas Navarro. Present during the inspection were six day care children and two facility assistants. This facility is a 4 bedroom, 2 bathroom single story home. Licensee accompanied LPA during this inspection. Operation hours are Monday through Friday from 6:00 a.m. to 7:00 p.m.

The fire extinguisher and smoke detector are operational. There is no carbon monoxide detector present. Hazardous items were observed in a locked cabinet during this inspection. Children’s toys and play equipment are available and observed free of hazards. Licensee was reminded that continuous supervision is to be given to children whenever engaged in outdoor activities. LPA did not observe any bodies of water in the home. Licensee states that there are no bodies of water in the home. Licensee stated there are no weapons maintained in the home. A fully fenced backyard is used for outdoor play.

Bedrooms #1 and #3 are used for daycare purposes. Living room, dining area, backyard covered patio, and fully fenced backyard are used for daycare purposes. The covered side classrooms are not to be used for daycare purposes. Licensee states that a makeshift roof has been added to the side classrooms six years ago.

Licensee’s First Aid and CPR certifications expire in 10/8/2026. Mandated Reporter Training certificate was reviewed and is current due to expire 11/7/26. LPA reminded licensee that Pediatric CPR/ First aid and Mandated Reporter Training expires every 2 years and shall be kept on file at the facility. The facility roster is maintained and was reviewed. Emergency exit drill requirement is being met. Last practiced and documented 1/25. Staff records reviewed on this date maintain required documentation.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was reviewed with licensee. Licensee stated she will contact LPA when there are children enrolled. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee and LPA discussed the facility emergency disaster plan, LIC 311D, and safety of children. LPA reminded Licensee of the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms. Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare.

On this date, 3/20/2025, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ. LPA provided the applicant with the California Megan's Law website: www.meganslaw.ca.gov.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile.

LPA informed licensee that this report dated 3/20/2025 document(s) (2) Type A citations which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPAs informed licensee to provide a copy of this licensing report dated 3/20/2025 that documents Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with licensee. Appeal Rights were discussed and provided.

A notice of site visit was given and must remain posted for 30 days.
