Licensing Program Analyst (LPA) Edgar Campana conducted an unannounced visit on 03/17/2022 to conclude complaint investigation. LPA was initially met by staff member Esperanza Fernandez and was allowed in to home. Licensee Ixchelle Scott arrived shortly thereafter and LPA informed Licensee of the reason for visit. LPA
toured the facility and census was taken. This agency has investigated the above listed allegations. Throughout the course of the investigation, LPA conducted interviews with licensee and several daycare parents, and toured facility on two occassions.

Regarding the allegation that Licensee keeps day care children in Pack ‘n Plays for extended periods of time, LPA interviewed four (4) daycare parents of which none indicated that they had any concerns with amount of time which children spend in Pack ‘n Plays at daycare. Daycare parents also stated that they are not allowed to enter that daycare due to COVID-19 precautions, and do not have any direct knowledge of how much time children spend inside of Pack ‘n Plays.

LPA also interviewed Licensee regarding how much time she leaves children inside of the Pack ‘n Plays. Licensee stated that children are only left inside of Pack ‘n Plays while they sleep and are not left inside for extended periods of time.

Regarding the allegation that facility is dirty, LPA toured facility and interviewed four (4) daycare parents. During tour of facility, LPA did not notice a lack of cleanliness which would pose a risk to health and/or safety of children in care. During daycare parent interviews, one out of four daycare parents expressed concern with the level of cleanliness at the daycare.

Regarding the allegation that Licensee is not providing napping equipment for infants, LPA toured facility on two occasions. LPA observed appropriate napping equipment for infants on both occasions. During interview, Licensee stated that all napping equipment with the exception of one (1) playpen were provided by parents. Licensee did not have proof of purchase date for the playpen she purchased, however.

Based on interviews conducted and LPA observations, there is a lack of evidence available to be able to draw definitive conclusions. Although the above allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore it is determined that the above allegations are UNSUBSTANTIATED.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A copy of this report and appeal rights (LIC 9058) were provided to the licensee. A Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview was conducted and report was reviewed with the licensee Ixchelle Scott.
