On 12/20/23 at 11:35 AM Licensing Program Analyst (LPA) Adrian Mangina conducted an unannounced Annual inspection with the Licensee, Janette Suarez. Ms. Suarez stated that Maria Suarez was at the store getting milk. There were 7 children in the playroom and Ms. Janette Suarez brought two infants to the living room from the bedroom at the end of the hall on the right. LPA observed that there was only 1 crib in that bedroom. The facility was out of ratio as only 1 licensee was present when LPA arrived and there were nine children present. Licensee Maria Suarez arrived at the facility at approximately 11:46 AM. The 3-bedroom, 1-bathroom single story home was toured and inspected to ensure an environment safe for the care and supervision of children. Licensee owns the home and has provided a tax bill as proof of control of property.

The licensee is using the following areas for daycare: living room, dining room, playroom, hallway, and bathroom. Off-limit areas as of today include: room 1, room 2, room 3, and kitchen. Business Hours are: 7:00 am-5:00 pm M-F. License Janette’s First Aid and CPR certifications expire on 9/2025 and Mandated Reporter Training AB 1207 was completed 9/18/23. Licensee Maria’s First Aid and CPR certifications expire on 9/2025 and Mandated Reporter Training AB 1207 was completed 9/19/23. Licensee was reminded to ensure that all off limits areas are made off limits to children and all items marked keep out of reach of children are kept in off limits areas or on a high shelf inaccessible to children. Licensee and staff meet immunization requirements. All required documents were posted. Last Disaster drill was conducted 8/14/23. Licensee has daycare insurance which expires 2/15/24. LPA reviewed nine child files. Child 7 and child 8 had no completed safe sleep plans. Licensee states this is their first enrolled day. Infants have not napped yet and there are no sleep logs to review. There is a working fire extinguisher rated 2A40BC located in playroom and combination smoke alarm/carbon monoxide detector located in hallway are operational. There is adequate heating and ventilation in the home. Children’s toys, play equipment and materials are available. Licensee states there are no firearms or weapons in the home. Entrance Checklist was provided to the Licensee.

A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated

Provider is hereby reminded of the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, ensure that all adults living or working in the home have criminal background clearances associated to the facility, corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers are not allowed in day care. All equipment that is used should be used only as intended by the manufacturer. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov. LPA Mangina directed Licensee to website: https://www.cdss.ca.gov/inforesources/community-care-licensing to receive important updates and information.

LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

On this date, 12/20/23, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. LPA Mangina informed Licensee Janette Suarez that this report dated 12/20/23 document one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Mangina informed the Licensee to provide a copy of this licensing report dated 12/20/23 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
