squeeze children’s hands and arms. Licensee explained there may have been a time when she may reach out to grab a child’s arm or hand in order to intervene to prevent injuries, if a child is running or is in danger. Facility assistant and children interviewed stated they have never observed the licensee handle a child in a rough manner. Parents expressed a high level of satisfaction with the care the licensee provides, stated their children have not mentioned being grabbed or pulled and appreciate the routine and care the licensee gives to their children.
It was also alleged that the licensee yells at day care children. Licensee denied the allegation; however, the licensee admitted that the tone of her voice is strong and loud, which could be perceived by others as though she is yelling. The facility assistant stated licensee has a strong voice, but can tell the difference between yelling and being firm and has never heard the licensee yell at daycare children. Daycare children interviewed confirmed the licensee has a loud voice, but do not consider it to be yelling and denied that they are threatened or frightened by the tone the licensee uses.
Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegation occurred. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are UNSUBSTANTIATED.
Exit interview conducted and report was reviewed with Licensee, Sandra Gil-Cervantes. A copy of this report, along with Appeal Rights (LIC9058 03/22), was provided. A Notice of Site Visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
