On July 7, 2022, at 10:15 AM, Licensing Program Analyst (LPA), Marie Hernandez conducted an unannounced complaint investigation inspection to deliver the complaint findings to the above allegations. LPA met with the Licensee, Maria Toledo. Present during the visit were seven children with the Licensee and the Adult Helper, Juanita Lazcano . Language Link Spanish Interpreter #13391 provided translation services in Spanish for the Licensee. Through the course of the complaint investigation inspection, LPA toured the facility, reviewed pertinent information, and conducted several confidential interviews with the Licensee, adult helper, Licensee’s children, six day care children, two former day care children, and eleven day care parents.

The Licensee denied the above allegations and stated no child was sexually exploited, no child was bullied, or hit by Licensee or left unsupervised, no child was left with a soiled diaper and that the children did not engage in inappropriate interactions with each other at the day care. However, it could not be determined whether the allegations occurred or not due to conflicting information obtained from the interviews and a lack of evidence.

The Reporting Party is adamant that the allegations occurred, and the Licensee is adamant that the Reporting Party is harassing her. As per the interviews, several children and several day care parents did not disclose anything inappropriate at the facility.

Based on the interviews and information obtained, there was conflicting evidence to corroborate the allegations that “Day-care child was sexually exploited while in care.” “Due to lack of supervision day-care children were engaged in inappropriate interactions with each other.” “Licensee failed to protect children from being bullied.” “Licensee hit day-care child.” “Licensee failed to meet day-care child’s diapering needs” and “Licensee left day-care children unsupervised.” Therefore, the allegations are found to be UNSUBSTANTIATED meaning that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred or did not occur. An exit interview was conducted and a copy of the report along with the appeal rights were provided to the Licensee, Maria Toledo.
