On 04/28/2023 at 1:05pm, Licensing Program Analyst (LPA) Selina Siao conducted an unannounced random inspection with helpers Himani Sharma and Nisha Rani Kashyap. Helpers stated that the licensee is currently out of town to attend a wedding and he will return on Sunday morning. The home was toured and inspected to ensure an environment safe for the care and supervision of children. Present at the facility were the two helpers and 9 day care children who are all preschool age. The home has a fully charged fire extinguisher, smoke and carbon monoxide detector that meet requirements and are operational. Most hazardous items were latched/locked and secured out of reach of children. Facility has a spa with cover located in the fenced backyard and helpers stated that there is no weapon in the home. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances. Both helpers have an EMSA approved pediatric CPR and First Aid card available for review and both have the required immunization measles and Tdap records available for review. Both helper does not have a valid online mandated child abuse training certificate. Facility representatives was reminded that the online mandated child abuse training must be renew every two years. All nine of the children’s records were reviewed and they are in ordered. Facility does not have a roster or a fire drill log available for review. Helpers stated that the last fire drill was conducted with the children about three months ago in January of 2023.

Licensee has provided adequate space for the children to eat, sleep and play within the home. Areas used for child care include family room (main day care area), play room and bathroom. Off limits areas includes the living room, garage and all of upstairs. There is a gate at the bottom of the stairs to prevent children's access and the garage is inaccessible by having the door closed. The facility has sufficient toys and equipment available. The home has a fenced backyard available for outdoor activities.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan. As their age and ability permit, newly enrolled children shall be informed promptly of their duties as required in the plan. (A) Each family child care home shall conduct fire drills and disaster drills at least once every six months. 1. The licensee shall document the drills, including the date and time of each drill. This documentation shall kept at the family child care home.

Based on LPA Siao's observation today, the licensee did not comply with the section cited above as the facility does not have a fire drill log available for review. Helper N. Kashyap stated that the last fire drill was conducted with the children in care in January/2023 but a drill log is not available. Which poses/posed a potential health, safety or personal rights risk to persons in care.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Licensee stated that he is planning to get rid of the spa and he will submit picture showing that the spa has been removed or latch and lock the spa cover to ensure children's safety. This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Facility representative was provided with the latest LIC311D and the Effects of Lead Exposure information that needs to be share with parents.



LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Child Care Providers can now sign up for Quarterly Updates and PINS through the DSS website at https://cdss.ca.gov/inforesources/community-care-licensing/subscribe. LPA discussed California Megan's Law with provider and advised her to go on the website at www.meganslaw.ca.gov.

Facility representatives was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
