On 11/07/2023 at 11:00 am, Licensing Program Analyst (LPA), Michelle Hood conducted an unannounced Annual Required Inspection and Change of Capacity and met with Licensee Leticia and Miguel Marquez. Miguel translated in Spanish. LPA notified the licensee the purpose of the inspection. There were four children present in the facility during this inspection. Miguel accompanied LPA inside and out of the facility during this inspection. The off-limits areas are inaccessible using door locks and safety gates. Per the licensee the operating hours are Monday trough Friday from 6:00 am to 6:00 pm.

On 10/30/2023, a fire clearance was granted. The fire extinguisher, smoke detector, and carbon monoxide detector met the requirements. All hazardous items were inaccessible to children. The licensee has toys, play equipment, and materials available. The fireplace is barricaded. The licensee uses the front yard for outdoor activities. The licensee understands there must be direct supervision while outdoors. No bodies of water were observed on the premises during the inspection. The licensee was reminded all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to the initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Licensee’s First Aid and CPR certifications expire on 04/2025. The licensee has required immunization's. Licensee completed Mandated Reporter Training on 07/2022. The facility roster is maintained and reviewed. LPA reviewed children’s files. The staff files were not available at the time of inspection. The last fire and disaster drills were conducted and documented on 06/23/2023.

LPA discussed the safe sleep regulations with the licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. There is one crib or play yard for each infant who is unable to climb out of the crib or play yard. Cribs or play yards are free from all loose articles and objects. The licensee physically checks on sleeping infants every 15 minutes. An Individual Infant Sleeping Plan [LIC 9227 (3/20)] is not maintained for each infant up to 12 months of age and shall be available to the Department for review. The licensee places infants up to 12 months of age on their backs for sleeping.

LPA discussed the following: Reporting Covid positive, suspected child abuse & neglect, maintaining children’s records according to regulation, and post required forms. The licensee was reminded corporal punishment, smoking, exersaucers, bouncy seats, walkers, jumpers, and/or similar equipment are not allowed in daycare. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov.

The maximum capacity for a large family child care home: 12 children (with a qualified assistant) with no more than 4 infants; or (with landlord consent) 14 children (with a qualified assistant) with no more than 3 infants, 1 child enrolled in kindergarten or elementary school and 1 child at least age 6 including children under age 10 who live in the licensee's home. When there are no Qualified Assistants, 14 years of age or present, the capacity reverts to the requirements for a Small Family Child Care. An exit interview was conducted, and the report was reviewed with the licensee Leticia Marquez. The licensing report will be e-mailed to the licensee and the licensee was advised that acknowledgment of receipt of the report and appeal rights (LIC 9058 12/15) are to be received within twenty-four hours. LIC 9213 NOTICE OF SITE VISIT FORM IS REQUIRED TO BE POSTED FOR 30 DAYS. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

A Regular Large Family Child Care Home license may be issued for 14 children upon final file review.
