On October 17, 2024, at 8:30 AM, Licensing Program Analyst (LPA), Diana Sanchez made an unannounced complaint inspection to deliver the complaint investigation findings for the above allegations. LPA met with assistant Graciela Lopez and explained the purpose of today’s inspection. Current census is 7.

This agency has investigated the above listed allegations. During the investigation, LPA conducted facility inspections, interviews with facility staff, outside program representatives, daycare children and daycare parents. Facility records and cellphone video footage was reviewed.

It was alleged that on 07/10/2024, licensee inappropriately handled daycare child #1 (C1) causing injury. Licensee and facility staff denied allegation, but admitted an incident involving C1 did occur. Licensee explained C1 engaged in a physical altercation with daycare child #2 (C2) and when she intervened, C1 began jumping on the furniture and then started to hit and kick her. The licensee stated she attempted to subdue C1 by hugging hIm; however, C1 slid from her arms to the floor; therefore, she held C1 down in order to deescalate the behavior and prevent injury.

According to the licensee and C1’s parent, the intervention technique was advised by a medical professional. Video footage obtained was inconclusive, as the view of the situation was obstructed by furniture; however, both the child and licensee are exhibiting a calm demeanor.

It was also alleged that the licensee yells at children in care. Licensee and facility staff denied the allegation, explaining that all children are treated with dignity and respect. Staff stated that provider is kind and calm when she speaks to the children in care. Most daycare children were unable to be interviewed due to limited verbal skills; however, one (1) daycare child stated the licensee doesn’t yell at children.

There are no other witnesses to corroborate the above allegations. Due to conflicting statements, LPA was unable to determine whether or not, the above allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Exit interview conducted and report was reviewed with assistant Graciela Lopez. A copy of this report, along with Appeal Rights (LIC9058), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
