32 | On 8/02/2023, LPA observed nine (9) children, between the ages one (1) year to almost four (4) years old, sitting in their highchairs watching television. Although the licensee stated they had just finished eating breakfast, all the children’s trays were empty and clean. Additionally, the licensee was not complying with at least one (1) of the highchair’s Manufacturer's Recommendation, by using it for a child over three (3) years old. The Graco brand highchair user’s manual states that the “highchair is designed to be used by a child up to three (3) years of age”.
Based on LPA observations, records reviewed and interviews which were conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 3), is being cited on the attached LIC 9099D.
LPA Sanchez informed licensee, Araceli Lara to provide a copy of this licensing report dated, 10/26/2023, that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with facility Licensee, Araceli Lara. A copy of this report, along with Appeal Rights (LIC9058), was provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
