On 06/08/22 at 4:35PM, LPA Luigi Gargaro conducted an unannounced case management visit to issue a repeat violation citation that was not issued during a previous 05/19/22 visit. The repeat violation occurred when the licensee was found to be out of ratio with four infants out of the eight children she had in care for the second time in four months after she was found with four infants out of the seven children present during a 02/02/22 visit.

During both visits, the licensee was caring for two children (one of whom was an infant) who belonged to her former roommate, Kerline Jean Phillipe, who Ms. Pierre states no longer lives in the home and whose children will not be part of the day care enrollment due to that fact. Ms. Jean-Phillipe was visiting today with her two children but the licensee only had four children in care including Ms. Jean Phillipe's children to be in appropriate ratio.

During today's visit analyst reviewed all of the licensee's remaining deficiency citations from her previous visits and found them to be completed. Analyst will review the licensee's current compliance record with his manager and will follow up with her regarding her pending capacity increase application when the review has been completed.

An exit interview was conducted and the report was reviewed the licensee. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Licensee disagreed with the issued citation and stated she will appeal it. Licensee refused to sign today's licensing report.

Licensee was cited a $250 civil penalty for the repeat out of ratio violation.The provider states that she has only three infants enrolled in her day care and that her former roommate, Kerline Jean Phillipe, whose child was the fourth infant during both previous visits, has moved from the home. Licensee provided analyst with Ms. Jean-Phillipe's current address information to assist in confirming she no longer resides in the home.

Based on observation, the licensee did not comply with the section cited above as on a 05/19/22 visit she had 8 children in the home, four of whom were infants, which poses/posed a potential health, safety or personal rights risk to children in care.
