On 02/05/24 at 12:30PM, Licensing Program Analyst (LPA) Luigi Gargaro conducted an unannounced case management visit with licensee Marie Pierre. The visit was conducted to issue a Type A citation and an immediate civil penalty for a 10/26/23 licensee self-reported child wandering incident. The incident involved a four year old child leaving the home and not being found until an hour later when he was returned to the provider by the San Diego Police Department.

Upon receipt of a type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months.

Analyst reviewed today's report with the licensee, Marie Pierre, and had her sign for it and the corresponding civil penalty assessment (LIC 421IM). Ms. Pierre was also provided a copy of her appeal rights for the civil penalty and a notice of site visit that must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Licensee was also advised that this does not preclude licensing from taking additional action against her license even after the submission of her correction plan.

Licensee was advised that a child wandering from a day care home is not acceptable and a serious violation of Child Care regulations as well as a serious risk to the health and safety of a child.

During a 10/26/23 incident, a four year old child in care wandered from the facility before being found and returned to the provider by the San Diego Police Department an hour later. Having a child elude the supervision of a day care provider without their notice is an immediate risk to their health and safety.

Licensee stated she has corrected the issue with the addition of locks on her gates and states will install an alarm on her patio door which alerts her to its opening. Licensee has also installed outdoor cameras. Licensee also will have an assistant present whenever she has over 4 children in care. Licensee submitted a written plan for the facility corrections to analyst during today's visit.
