On 02/14/24 at 3:10PM, Licensing Program Analyst (LPA) Luigi Gargaro conducted an unannounced case management visit with licensee Marie Pierre. The visit was conducted to issue a Type A citation and a repeat immediate civil penalty for a second, earlier 10/19/23 child wandering incident that the licensee failed to report to the Department. The unreported incident involved the same four year old child who the licensee did report wandered from the home on 10/26/23.

The licensee was also cited a second Type A citation for conduct inimical for not being forthcoming about the initial incident and providing false statements about both the first and second incident and a Type B violation for failing to report the 10/19/23 incident to the department.

Upon receipt of a type A violation, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months.

Analyst reviewed today's report with the licensee, Marie Pierre, and had her sign for it and the corresponding civil penalty assessment (LIC 421IM). Ms. Pierre was also provided a copy of her appeal rights for the civil penalty and a notice of site visit that must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Licensee was also advised that this does not preclude licensing from taking additional action against her license even after the submission of her correction plan.

Licensee was advised that a child wandering from a day care home is not acceptable and a serious violation of Child Care regulations as well as a serious risk to the health and safety of a child.

Based on interviews and record reviews, it was determined that a four year old child in care wandered from the facility on 10/19/23 before being found by his father at a neighbor's several houses down from the provider. Having a child elude the supervision of a day care provider without their notice is an immediate risk to their health and safety.

Licensee submitted a previous written plan of correction to prevent such future incidents that included installation of preventative equipment such as locks and alarms, home cameras and an increased supervision plan.

Analyst and licensee discussed the Licensee's obligation to be truthful with the Department in all her interactions with them and her relation of all incidents that affect the day care. Licensee states she will submit a written statement to that effect to analyst to comfirm this and address the deficiency by 02/15/24.

Based on confidential interviews and reviewed reports, it was determined that the Licensee was untruthful with the Department about two separate incidents in which the same four year old child wandered from her facility. This poses an immediate health and safety risk to children in care.

LPA also informed licensee that this information will be forwarded to the Department’s Legal Division for further review for an ongoing administrative action.
