On 11/07/2023, at 12:30 p.m., Licensing Program Analysts (LPAs) Edgar Campana and Thien-Vu Dinh conducted an unannounced complaint visit to this facility to deliver the findings for the above allegations. Analysts met with licensee Carmen Rocha. LPAs informed Rocha that the reason for the visit was to deliver the findings of a complaint investigation. Present were five (5) daycare children and a cleared an associated adult. During the course of the investigation, this agency conducted interviews with the licensee, licensee’s spouse, daycare children, and daycare parents.

Regarding the allegation that provider withholds water from daycare children, facility policy for providing water to daycare children was discussed with licensee and licensee’s spouse. Licensee and spouse stated that younger children bring “sippy” cups to the facility, and older children can choose from colored cups provided by the facility. Licensee and spouse added that children are given water whenever it is requested. LPA Campana was also shown multiple 5-gallon water bottles located in the garage, which are intended for daycare use.

During daycare parent interviews, one (1) out six (6) daycare parents interviewed expressed having some concern regarding daycare child hydration at facility. During daycare children interviews, all three (3) daycare children stated that they have free access to water while at the facility.

Regarding the allegation that an adult in home makes inappropriate comments to daycare children, interviews were conducted with daycare parents, daycare children, licensee and licensee’s spouse. During interviews with daycare parents, none indicated having any knowledge regarding this allegation. During interviews with the licensee and licensee’s spouse, both denied having knowledge of inappropriate comments being made to daycare children at the facility. During daycare child interviews, no conclusive evidence regarding this allegation was obtained.

Regarding the allegation that an adult in home encourages daycare children to use profanity, interviews were conducted with daycare parents, daycare children, licensee and licensee’s spouse. During interviews with daycare parents, none indicated having any knowledge regarding this allegation. During interviews with the licensee and licensee’s spouse, both denied having knowledge of any adult at the facility having encouraged daycare children to use profanities. During daycare child interviews, no corroborating evidence regarding this allegation was obtained.

Regarding the allegation that an adult in home yells at provider in presence of daycare children, interviews were conducted with daycare parents, daycare children, licensee and licensee’s spouse. During interviews with daycare parents, one (1) out of six (6) parents interviewed stated that their child once commented that licensee’s spouse yelled “mean things” at licensee. During interviews with the licensee and licensee’s spouse, both denied having knowledge of an adult yelling at licensee while in the presence of daycare children. During daycare child interviews, no corroborating evidence regarding this allegation was obtained.

It should be noted that that daycare parent P1 did not wish for their child, C1, to be interviewed.

There is conflicting evidence obtained during the investigation. Though the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

An exit interview was conducted and the report was reviewed with licensee, Carmen Rocha. No deficiencies cited. A copy of this report, along with Appeal Rights (LIC9058 03/22), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
