32 | Based on the IB investigation, interviews, documents, and collaboration with outside agencies, the preponderance of evidence standard has been met, therefore the allegation of an adult in the home inappropriately touched a daycare child is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 3, is being cited on the attached Complaint Investigation Report (LIC 9099D).
The Department has determined that an enhanced civil penalty in the amount of $2,000.00 is being assessed and issued during today’s inspection. Pursuant to Health and Safety code section 1597.58, a violation that the Department determines constitutes physical abuse or resulted in serious injury, as defined in Health and Safety Code section 1596.8865, to a child, the civil penalty shall be assessed is two thousand dollars ($2,000.00) for a large family day care home. For purposes of Health and Safety Code section 1597.58, sexual abuse is defined in Section 11165.1 of the Penal Code when the person responsible for the child’s welfare is a licensee, administrator, or employee of any facility licensed to care for children. LPA reviewed the Civil Penalty Assessment - Serious Bodily Injury/Physical Abuse (LIC421D) with Licensee's sister, Marilou Ramos.
LPA Hood informed Ramos that this report dated July 2, 2025 documents one (1) Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Hood informed the Ramos to provide a copy of this licensing report dated July 2, 2025 that documents any Type A citation to parents/guardians of all children currently enrolled or the next day children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview was conducted, the report and LIC 421D were reviewed with the Marilou Ramos. Notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Ramos stated she will provide the Licensee Aurea Delos Santos the licensing documents.
LPA observed the Temporary Suspension Order (TSO) Notice posted on the exterior door of the facility, affixed to the door by the department on March 21, 2025.
