On 7/19/21 at 8:00am Licensing Program Analyst (LPA), Martha Malane conducted an announced third change of location pre-licensing inspection. The purpose of the inspection is to ensure the applicant fully moved into and occupies the home. LPA and applicant discussed the following regulations:
  • Health and Safety Code: 1596.78 “Family day care home” "Family day care home" means a home that regularly provides care, protection, and supervision for 14 or fewer children, in the provider's own home, for periods of less than 24 hours per day, while the parents or guardians are away, and is either a large family day care home or a small family day care home.
  • Title 22 , Division 12 Chapter 1 code of regulations 102352 Definitions (h) (1) "Home" means the licensee's residence as defined by Government Code Section 224.

Government Code Section 224 states: In determining the place of residence the following rules shall be observed: (a) It is the place where one remains when not called elsewhere for labor or other special or temporary purpose, and to which he or she returns in seasons of repose. (b) There can only be one residence.
  • 102417 Operation of a Family Child Care Home (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day.

LPA provided applicant a copy of the above regulations regarding a licensee’s residence and presence in a family child care home, applicant, Celine Theano stated she understood and will comply with all regulations set forth by the Department for family child care home licensure.

An exit interview was conduct and applicant was provided a copy of this report. A small family child care home license is granted effective today’s date, 7/19/21.
