On 08/20/2024, at 10:40 AM, Licensing Program Analyst (LPA), Daniela Huerta conducted an unannounced complaint inspection to deliver findings for the above listed allegation. LPA met with Licensee, Ma Martinez Sierra and advised licensee of the purpose of the inspection and conducted a tour of the facility. There were two (2) children present and two (2) staff and licensee during the inspection.

During the course of the investigation, interviews were conducted with licensee, three (3) staff, three (3) daycare children, four (4) daycare parents and two (2) relative of alleged victim. The facility roster, video and records were obtained and reviewed by LPA.

It was alleged that on 07/17/2024, the licensee used an inappropriate form of discipline by placing daycare child #1 (C1) in a dark room located on the second floor, in an off-limit area of the facility. The licensee and staff interviewed denied the allegation, stating they have never placed a child in a dark room, nor have they taken children upstairs, stating children are not allowed upstairs.

When interviewed by LPA, C1 did not have any recollection of the licensee or the alleged incident. Daycare children interviewed stated they have not received inappropriate forms of discipline by licensee or staff, nor have they observed anyone else receiving inappropriate forms of discipline. All daycare children interviewed denied being placed in a dark room by licensee or staff. All daycare children indicated they have never gone upstairs, further stating they are not allowed upstairs. Daycare parents interviewed expressed satisfaction with the care the licensee provides.

Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegation occurred. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview conducted and report was reviewed with licensee, Ma Martinez Sierra. A copy of this report, along with Appeal Rights (LIC9058 03/22), was provided. A Notice of Site Visit was given and must remain posted for 30 days. .
