Licensing Program Analysts (LPAs), Luigi Gargaro, and Claudia Amador conducted an announced pre-licensing inspection with the applicant, Stacie Sotomayor. The purpose of the inspection is to ensure that the home is in compliance with standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. This two-story, four-bedroom, two-and-a-half-bath home was toured and inspected.

The applicant will use the following areas for childcare: the kitchen, dining room, main day care area, ½ bathroom, and the backyard. Off-limits areas include garage and entire upstairs (4 bedrooms, 2 bath). The second floor of the home is made inaccessible to day care children through child safety gates that are installed at the bottom and top of the home staircase. The applicant understands the gates must be in place when children under five years are present during day care hours. The garage is made off limits with a locking door handle. The home fireplace is appropriately screened and latched. The applicant will utilize the backyard for outdoor activities. The yard is properly fenced. The applicant has an off limits left side alleyway that contains trash cans and other items. It is made off limits with a safety gate that is installed at the alleyway entrance. There are no bodies of water observed during the time of visit. The applicant was asked whether she has any weapons in the home and she replied no. The fire extinguisher is rated 2A 10B:C and is in the kitchen, smoke and carbon monoxide detectors meet requirements and are operational. All poisons, detergents, cleaning compounds, and medicines are inaccessible to children in care and are in off-limit areas with cupboard latches and secured out of reach of children. Children’s toys and play equipment are available. The applicant has a working telephone/cell phone.

The applicant maintains documentation of proof of control of the property for review by the Department. Applicant completed Mandated Reporter AB1207 training certification on 11/04/21. The applicant has completed the 8 hours of preventative health. Pediatric CPR and First Aid certifications expire on 01/2024. Applicant and adult residents in the home have criminal record clearances and/or exemptions on file. The applicant was advised that any new/additional adults must be cleared prior to working or residing in the home. Any minor upon their 18th birthday must be fingerprinted.

Applicant has required proof of Immunization records per SB792 on file. LPA advised that prior to making alterations or additions to the home or grounds, the applicant shall notify the Department of the proposed change. Applicant states she is financially secure to operate a family childcare home for children and will comply with all regulations and laws governing family childcare homes. The hours of operation are Monday through Friday, 7:30 a.m. to 5:30 p.m.

The applicant does not plan on providing Incidental Medical Services (IMS) to clients at this time. IMS policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA reviewed with the applicant the LIC 311D, Forms/Records to Keep In Your Family Child Care Home, children’s forms/records, facility forms/records, and information to be posted. The applicant was also informed the following items are prohibited during daycare operating hours (walkers, exersaucers, jumpers, and bouncy seats). Corporal punishment and smoking are not allowed in the daycare.

LPA discussed the maximum capacity for a small family child care home: four infants only (infants mean any children under 24 months); or six children with no more than three infants; or, with landlord consent, eight children with no more than two infants, one child in kindergarten or elementary school and one child at least age six, including children under age 10 who live in the home. Landlord Consent is on file.

Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

An exit interview was conducted and the report was reviewed with the Applicant, Stacie Sotomayor.

No corrections are required and a license for eight will be issued today at this location. A copy of the report was provided to the applicant.
