32 | children interviewed, one (1) child stated she observed staff #1 (S1) pull daycare child #2’s (C2) ear and on another occasion observed (S1) hit daycare child #3 (C3) on the head while he was sitting at the table. The LPA attempted to interview (C2) and (C3) however, they did not provide verbal responses to the questions asked due to their limited communication. Daycare parents interviewed did not express any concerns regarding the facility discipline policies.
It was also alleged that the licensee is not meeting daycare children's toileting needs. The licensee denied the allegation, explaining she has a schedule to change diapers and to take the children to use the bathroom. Staff interviews gave conflicting information. Two (2) out of four (4) staff revealed that the licensee does not provide help when children need to use the potty which results in children having potty accidents.
LPA received conflicting testimony from the eight (8) daycare parents interviewed, most acknowledged their children have had toileting accidents in the past; however, two (2) parents reported concerns about communication for toileting accidents, with one (1) parent adding additional concerns about diaper rash, the use of different diapers than the ones provided, and unchanged soiled diapers.
It was also alleged that the licensee leaves daycare children in car seats. The licensee denied the allegation, stating that she immediately removes children from the car seat at drop off and moves them to the crib when appropriate. The licensee stated she continuously reminds the parents that infants are not allowed to remain in the car seats at drop off. Staff interviews did not reveal any corroborating information. Parent interviews did not reveal any concerns about the licensee use of car seats. Children interviews did not reveal any relevant information.
Additionally, it was alleged that licensee does not allow daycare parents to enter the home. The licensee stated that parents are allowed to enter the facility, however she stated that one (1) parent asked to be present in the facility and the licensee told her she needed to ask licensing. Staff interviewed gave conflicting information. Two (2) out of three (3) staff interviewed stated parents are not allowed to enter the facility and usually just leave the children at the door. Parent interviews revealed that they were allowed to enter the facility or did not want to enter the facility.
Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated
Exit interview conducted and report was reviewed with the licensee. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
