On 07/02/2025 at approximately 12:47 PM. Licensing Program Analyst (LPA), Julieta Abrego conducted an inspection to conclude the complaint investigation regarding the above allegation. LPA met with licensee Patricia Pavia and advised licensee of the purpose of the inspection and conducted a tour of the facility. There were nine (9) children present during the visit.

During the investigation, interviews were conducted with the licensee, staff, daycare children and authorized representatives. In addition, LPA reviewed staff and children's files, obtained a copy of a children's roster, and reviewed photos.

Based on LPA observations and interviews conducted, it was determined the licensee provided moldy water cups to children in care on at least one (1) occasion. During inspection conducted on 04/10/25, LPA observed four (4) out of ten (10) sippy cups used by daycare children to contain a black mold-like substance in and around the threads and straw areas of the cup lids. The licensee and staff denied providing moldy cups to children in care, explaining that parents take the cups home every Friday to clean them and return

them the following week; however, parents interviewed reported that they do not take the cups home for cleaning.

Additionally, it was determined that staff do not implement proper infant sleep practices by not maintaining one (1) crib or play yard for each infant in care. On 04/10/2025, during inspection, LPA observed three (3) infants present with only two (2) available play yards. Staff interviewed stated the additional infant would sleep in a stationary “rockaRoo” on a cot or mat instead. Witnesses interviewed indicated that they had seen infants sleeping in rockaRoos with blankets on multiple occasions.

Furthermore, the licensee did not ensure proper supervision was provided to daycare Child #2 (C2) on multiple occasions. On 04/10/2025, during inspection, LPA observed C2 unsupervised outside in the backyard, playing with rainwater pooled in a play kitchen sink. C2 was observed wetting his hands, bringing them to his mouth, and attempting to drink the water. C2 was unsupervised for approximately 10 minutes until the licensee took C2 back inside the home. Witnesses interviewed confirmed that it was common for C2 to be outside unsupervised, often attempting or putting things in their mouth.

Based LPA observations and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Per California Code of Regulations (Title 22, division 12 & Chapter 3) 3 Type A citations are being cited on the attached 9099-D page.

LPA Julieta Abrego informed Licensee, Patricia Pavia that this report dated 07/01/25 document(s) three (3) Type A citation(s) which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Julieta Abrego informed Licensee, Patricia Pavia to provide a copy of this licensing report dated 07/01/2025 that documents Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

LPA met with licensee Patricia Pavia and advised licensee of the purpose of the inspection and conducted a tour of the facility. There were nine (9) children present during the visit.

It was alleged that the staff did not meet children’s diapering needs by not changing them frequently resulting in diaper rash. Licensee and staff denied the allegation, explaining that children’s diapers are change every two (2) to three (3) hours and ointment is applied if needed. Parents interviewed had no concerns about the licensee’s diapering practices.

It was also alleged that the licensee excluded children from play activities. The licensee denied the allegation, explaining that she protects the younger children based on their age and development and that older children are not encouraged to interact with younger children due to safety concerns. stated there are different activities for children depending on their ages. Children interviewed revealed that there were some activities for them, but they mostly were left to watch television.
Additionally, it was alleged that there were hazards (soiled diapers) accessible to children in care. The licensee denied the allegation, explaining that soiled diapers are immediately discarded in the trash. On 04/10/2025, during inspection, LPA observed a trash can containing soiled diapers located in the backyard. Although, no daycare children were present in the backyard, LPA discussed the importance of maintaining hygienic diaper disposal practices. During the inspection, the licensee moved the trashcan into the garage. Children interviewed indicated the infants are changed inside the infant room and diapers are disposed in a trashcan outside the garage door and stated the trashcan has a bag. Daycare parents interviewed did not disclose any concerns about the licensee’s diaper disposal practices.

Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated
