On 07/02/2025 at approximately 11:30 AM. Licensing Program Analyst (LPA), Julieta Abrego conducted an inspection to conclude the complaint investigation regarding the above allegation. LPA met with licensee Patricia Pavia and advised licensee of the purpose of the inspection and conducted a tour of the facility. There were 9 children present during the visit.

During the investigation, interviews were conducted with the licensee, staff, daycare children and authorized representatives. In addition, LPA reviewed staff and children's files and obtained a copy of a children's roster.

Based on interviews conducted it was determined that on February 19, 2025, the licensee engaged in a verbal altercation with Staff #1 (S1) in the presence of daycare children. Two (2) daycare children interviewed described hearing both, the licensee and S1 yelling during the argument which made them feel “scared”, unsafe, “spooked” and “uncomfortable”. Both the licensee and S1, acknowledged the incident

occurred. Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Per California Code of Regulations (Title 22, division 12 & Chapter 3), one (1) Type A citation is being cited on the attached 9099D page.

LPA Julieta Abrego informed Licensee, Patricia Pavia that this report dated 07/02/2025 documents one (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Julieta Abrego informed the Licensee, Patricia Pavia to provide a copy of this licensing report dated 07/02/2025 that documents Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the licensee. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

It was alleged that the licensee does not treat daycare children fairly by favoring a relative child (C1) in the daycare. The licensee denied intentionally treating any of the daycare children unfairly. Children interviewed stated C1 uses inappropriate language and hits or pushes other children and when the concerns were raised to the licensee, she would dismiss the concerns. Daycare parents interviewed did not express any concerns

that daycare children were treated unfairly.

Additionally, it was alleged that the licensee does not provide adequate supervision to the daycare children in care. The licensee denied the allegation stating there are always staff present watching children. Children interviewed revealed that they felt staff focused on the young daycare children and were less attentive to the older children.

It was alleged that the licensee had inappropriate interaction with daycare children by speaking negatively about a former staff member to daycare children. The licensee denied the allegation, explaining that she provided children with a response when questioned about a former staff member. According to the licensee, she told children that the former staff was not “good”. Children interviewed stated that the licensee said she did not trust the former staff. There were no other witnesses to the alleged incident.

Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
