On March 7, 2024, at 1:30pm, Licensing Program Analysts (LPAs), Vicky Williamson and Oscar Picazo conducted an unannounced annual random inspection and inspected the facility for the purpose of a change in capacity. LPA met with Licensee's Assistant Antoine Lapaix and disclosed the purpose of the inspection. Also present was licensee's three children. There were no daycare children present. At 2:10pm, Licensee, Wensesee Lapaix arrived to the facility. Days and hours of operation are Monday through Sunday, 6:00am - 11:00pm.

This two story, 5 bedroom, 3.5 bath house was toured and inspected.  LPA accompanied by assistant toured the inside and outside of the home. The following areas are used for childcare: family room, daycare room (bedroom on first floor), bathroom 3 (daycare room bathroom), kitchen nook area, and back yard. The off-limit areas are kitchen, front dining room, bathroom 4 (hallway), garage, and entire second floor (bedrooms 1 - 4 & bathroom 1 & 2). The off-limits areas are made inaccessible to day care children by use of door locks and a safety gates. Licensee was reminded when children under 5 years old are present, the stairs must be fenced or barricaded. Licensee stated that she understood.

The fire extinguisher, smoke detector, and carbon monoxide detector meet requirements. All cleaning compounds, medications, and other hazardous items were inaccessible to children during the inspection. Licensee has a working cell phone in the home. The licensee has age-appropriate toys and play equipment available. Licensee stated there are no bodies of water on the premises. Licensee stated there are no firearms or weapons in the home.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. During the exit interview, the Licensee, Wensesee Lapaix confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

The agency received a granted fire clearance approval on 2/2/2024.


LPA and licensee discussed the maximum number of children for whom care shall be provided when there is an assistant in the home, including children under age 10 who live in the licensee's home shall be either: Twelve (12) children with no more than four of whom may be infants and 8 older children over the age of 2 years or Fourteen (14) children, with no more than three infants (birth to 24 months) and at least two of the children with 1 child enrolled in kindergarten and 1 child at least six years of age.

Licensee provided control of property to the department.

A Large Family Child Care Home license may be issued upon final file review.

Exit interview conducted and report was reviewed with the Licensee, Wensesee Lapaix. A copy of the report and Appeal Rights were provided to the licensee. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Pediatric CPR/First Aid certification for licensee is valid through 5/2024 and for assistant 11/28/2025. Licensee has the required immunization records on file. Mandated Reporter training certification for licensee and assistant valid. LPA informed licensee to ensure the mandated reporter training is completed once every two years. LPA observed the required documents posted. A sample of children’s files were reviewed and were determined to be complete. The last fire/disaster drill was conducted and documented on 10/11/2023.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA and licensee discussed the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms. Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare. See LIC 809C Continuation...
