On 04/03/24 at 3:45PM, Licensing Program Analyst (LPA) Luigi Gargaro conducted an announced prelicensing inspection with the applicant. The purpose of the visit is to ensure the home is in compliance with standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. Present during the visit were applicant Holette Sagesse and her daughter Nephtalie Sagesse. Ms. Sagesse speaks and understands some English but her daughter was present today to provide translation when needed.

The two floor, four bedroom, three bathroom house was toured and inspected to ensure an environment safe for the care and supervision of children. The fire extinguisher and smoke and carbon monoxide detectors meet requirements and are operational. All hazardous items were latched/locked and secured out of reach of children. Analyst inquired if there are any weapons in the home and the applicant replied no.

Applicant has a pool and jacuzzi in the home front yard that are set off in a gated area but require changes made to fencing to meet child care requirements (see page 3 of report). A review of records on this date indicates that all adults or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions.

Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home.

A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. Applicant owns the home and provided proof of control of property in the form of Trust Agreement that she submitted with her original application. First Aid and CPR expire on 02/04/25 for the applicant.

Applicant will be using the following rooms for childcare: the living/primary day care room, the office area (immediately off the primary day care room) and the bathroom. The following areas will be off limits: the dining area/kitchen, the second living room, the bedrooms located on the first floor of the home, the laundry room, the second floor of the home and the garage. The dining/kitchen area is made off limits from the living/day care room with a door that has a highly placed bolt. The two bedrooms are made off limits with door knob covers that are installed on their respective door handles. The laundry room is located off the off limits second living and also has a door knob cover on its door handle.

The second living room is immediately to the left of the off limits dining/kitchen area and cannot be accessed from there. The applicant is to install a retractable gate to make the second living room inaccessible from the home office area. She also has to install a safety gate at the bottom of the home staircase to make the second floor inaccessible. The garage is made inaccessible as it is located behind the off limits second living room.

The applicant has sufficient day care equipment and materials available. The applicant will neither be using her front or backyard for outdoor activities and will instead take children to a local park for outdoor activities whenever necessary. The backyard is made off limits with a latching gate. The front yard, which contains the pool and jacuzzi is solely a pass through area to arrive at the front door of the home.

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Incidental Medical Services (IMS) policy was discussed. For IMS information, see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA reviewed with applicant the LIC 311D, Forms/Records To Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the applicant. The new provider packet was also reviewed with the applicant including information on child abuse reporting, shaken baby syndrome, SIDS, Lead Poisoning Facts and the YMCA Resource Center. Applicant was reminded that corporal punishment, smoking, walkers, exersaucers, jumpers and bouncy seats are not allowed in day care.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform. Exit interview conducted and report was reviewed with the applicant, Holette Sagesse. A license for 8 will be issued effective after the following corrections has been completed: 1) applicant's pool entrance gate currently does not self close or self latch and latch is more than six inches from top of gate. Applicant states will have gate spring and latch replaced to be reinspected by analyst on return prelicensing visit; 2) applicant has filigrees on portions of pool gating that are potentially climbable. If removal is not an option, photos to be reviewed with manager to discuss other potential options to make them inaccessible; 3) applicant has adult residing in connected room that has an entrance from the home garage. Applicant states will have him submit to Livescan fingerprinting and submit cleared TB test/x-ray result; 4) applicant will install safety gates at entranceway between for use office area and off limits second living room and at bottom of home stair case to make second living room and second floor of home completely inaccessible to day care children.
